************ was renting a portable shed from our company on a month-to-month basis.  After several missed payments, we sent a driver to pick up the shed.  The driver loaded the shed onto his trailer and was about to leave with the shed when ************ arrived and paid the amount necessary to reinstate the contract.  We directed the driver to set the shed back down and leave.  Afterwards, ************ called our office and said the shed had scraped against a tree during loading and the septic system was damaged.  He emailed pictures of the damage to the shed and what looked to be some ruts in the yard along with a repair estimate from a septic company for $10,000.00 to completely replace the entire septic system. I immediately waived the pickup and re-delivery fee that the driver charged as an attempt to de-escalate the situation.  I agreed to send the driver back out at no cost to ************ in order to repair the damage to the shed and make sure it was set up properly, but I wanted to wait until the septic issue was resolved first.  I told ************ that I wanted to get my own inspection done regarding the septic system because I have no way of knowing what condition the system was in before the driver arrived, and if the driver actually did any damage to it.  I contacted a local septic repair company and paid for them to inspect the system.  According to the inspector, the septic system was already in poor condition due to age and improper maintenance and repairs.  He could not verify the claims that ************ was making regarding damage caused by the driver. The septic inspector also advised that ************ asked him to make up an estimate that aligned with his claim, even though the inspector had already given him the results, and that ************ said he was getting ready to sell his property and needed a new septic system before the sale.  In light of the septic inspector's information, I decided that continuing the contract with ************ was not in our best interest and requested that ************ make the shed available for pickup.  He declined.

I strongly feel that we have no liability to buy an entirely new septic system for *************  However, as an accommodation and an attempt to resolve this issue without further conflict, I will waive the pickup fee and any past due rent and late fees that have accrued since the original incident, and I will send ************ a check for $1,000.00 to use as he sees fit.  In exchange, ************ will need to make the shed available for pickup as soon as possible.  Once we have the shed back in good repair, we will issue the check to *************  I hope this is an acceptable solution and we can put this behind us.
