    I was sold resale oakmont resort and wasn’t told any limitation can’t book summer months prime time when did transfer until completed , and couldn’t use 2024 one bc I couldn’t travel times they said and I didn’t want pat 2025 wanted deed reversed bc misled on it and I spoke corporate cherise extension 227 and explains situation and was told also by main office speak Katy they will work on giving me second week from loss of the first so I said okay and paid the 565$ maintenance and now after the fact I told that they won’t give me that bonus week for loss , this is not okay

    According to notes on this account:  *** **********s flexible use deed came to the Oakmont Resort association office from Switch It Title Exchange, Seymour, TN. Notes on the account show Switch It was told 5/22/24 that a new owner may not get a 2024 reservation because "flexible use" weeks require booking one year in advance subject to inventory (first come/first serve). Flexible use weeks are weeks 1-21, 36-39 and 44-52. Switch It is very familiar with Oakmont Resort flexible use. *** **********s deed was recorded and sent to Oakmont on 8/13/2024.  The staff at Oakmont Resort did try to accommodate a 2024 week by giving him a "courtesy week" in January of 2025. He was a no show for that week. He contacted Oakmont Resort on 4/28/25 asking for a 2025 courtesy week "outside of normal courtesy week time" and at that time stated several times that he realized it was the company he purchased through online that misinformed him on how flexible use weeks work.  The resort had to deny his special request as all flexible use homeowners are treated under the same fair protocol. Resort staff encouraged him to contact the flex reservationist to see if she had any cancellations.  Flexible use owners are required to pay annual maintenance even if they are unable to reserve a flexible use week in a given year. Switch It is familiar flexible owner protocol. 

    We are confused as to why he would file a complaint on Oakmont Resort as it sounds like his contention is with Switch It Title Exchange or the company he purchased his flexible use week from online as he will never have use of summer weeks unless he reserves by making a rental reservation during the summer. Oakmont Resort rental inventory is based on owners that cannot use their weeks and place them for rent at the resort. *** ********* would receive a discounted owner nightly rate when making a rental reservation. 

    *** ********* holds a deed of record for Tennessee fee simple real estate. The deed enables him to sell his week if/when ownership does not make sense for his travel needs. Otherwise, he should contact Switch It Title Exchange or the online company he purchased from to see if they can rectify what he believes to be an error on their part. Oakmont Resort Condominium Association Inc. does not buy or sell weeks and cannot assist owners in selling.

    I was told if I purchased said property within a month I would be out of the time share business forever. Now I am trying to get them to sell Oakmont property $36000.00 as promised they said with no charges. Larry ******** and Christy **** since purchase have avoiding getting this done. I tried to cancel contract within 10 days as legal they said I could not I paid cash.I sent you the letter I sent them and purchase agreement Christy **** had COVID and did not answer my calls for days after sale.

    As previously stated, Mr. ******** has limited hours due to personal circumstances. I am not at liberty to provide sales documents concerning Ms. G***** purchase but I can provide the following: On 11/8/24, Ms. G***** returned deeding instructions and $175.00 to finalize the Oakmont Resort week deed in her name. Also attached is the copy of the referral document that Ms. G***** signed noting she wanted to no longer own at Plantation Resort in Myrtle Beach SC. No mention of Oakmont Resort week.  I believe these documents provide adequate back up that Ms. G***** was aware she purchased a week at Oakmont Resort. Perhaps she developed buyers remorse after her purchase and after the 10 days recission period, which is Tennessee law or perhaps she only wanted to receive the discounted referral fee for her SC timeshare. Whatever the case, the deed entitles Ms. ***** to resale her Oakmont Resort week, at any time and for any reason. If she is not comfortable marketing/selling her week on her own, she should contact a resale company to assist her. She keeps mentioning selling her week for $36,400 but I think she may be confusing "points" with a "sales price". Why would she think that her Oakmont Resort week would sell for $36,400 when she just paid less than half of that amount to purchase it?  At time of her purchase, Ms. G***** enrolled her week into RCI Points, she received 36,400 "points" to use at various other resorts. I recommend she contact RCI to hear about those vacations and to make a reservation: 877-968-7476. Her RCI user number* ********** She keeps mentioning "selling contract coming to me since November". Again, neither Tree Tops Real Estate nor Oakmont Resort homeowner association assist in owner resale. Mr. ******** did ask the appropriate person to send her an owner resale packet as soon as time allows as the association office has limited time during January and February fielding owner maintenance fee calls. I mailed her the owner resale packet yesterday. If she is not comfortable marketing/selling on her own, she should contact a resale company. Thank you.
