    I am a physician in Internal Medicine solo private practice in ************, *******. My office was approached by an aesthetic device company with equipment that could be of benefit to my patients. In this case, the equipment was used to treat incontinence. The aesthetic device company in question is *** Industries and the device is the Emsella chair. *** introduced me to Leasepoint Funding Group, LLC. Leasepoint's role was to provide the financing for the device which *** would provide our office. Representatives from both companies misrepresented the terms of the agreement to me during their presentations. Both *** and Leasepoint made it clear to me that the only collateral and the only property at risk in the case of default was the repossession of the machine itself. It was explicitly stated to me personally that there would be no personal guarantee attached to the agreement. The issue was discussed in detail and addressed directly. There was no confusion on this point. This representation was the key factor in my determination to sign the contract.Since signing the contract, the device has proven not to be financially viable in a small practice setting, so I have attempted to return the device as was promised to be the sole remedy in the terms stated to me by the *** and Leasepoint representatives. Leasepoint has chosen not to receive the device and the default of the contract has led to a lawsuit against my practice and myself personally.Both Leasepoint and *** have not only misrepresented a key term of the contract but also engaged in questionable marketing practices such as high pressure, time-sensitive incentives and refusing to give me the time needed to perform due diligence with regards to their offers. I am concerned that my experience with these companies is not an isolated incident but represents a pattern of marketing their device and financial services which is predatory and fraudulent.
