On January 31, 2025, I-*********************** paid $65,000 in full to Capital Asset Exchange and Trading, LLC (CAE) for the purchase of 36 used ******* dry pumps under Order #*****B.CAE confirmed that all 36 pumps were available and committed to shipping them within a 10-business-day window. Despite repeated follow-ups and our full cooperation with their compliance and documentation requests, they failed to fulfill the delivery. As of May 16, 2025, more than 15 weeks have passed, and we have not received the equipment or any confirmed shipment schedule. The business has continuously stalled by rehashing resolved issues (e.g., compliance forms, decontamination), failed to respond in a timely or coordinated manner, and provided contradictory information across their team. No units have shipped, and no legitimate delivery plan has been shared. This has caused serious operational disruption to our business. We have lost all confidence in **** intent and ability to fulfill their contractual obligation. We are requesting a full refund of $65,000 plus interest due to non-delivery, breach of agreement, and continued failure to perform.

CAE and I-Forwardtech entered into an as-is and where-is transaction.  The agreement between CAE and I-Forwardtech does not stipulate a delivery date, given the many variables in a transaction of this nature, consisting of 36 units.  I-Forwardtech's claims pertaining to quantity and condition of the equipment are inaccurate, and CAE has provided verifiable evidence which contradicts their statements.  While we acknowledge that the shipment has taken longer than any of us would have like, *** has not breached the contract in any manner, and is in daily communication with I-Forwardtech regarding this shipment, which is in transit and expected to arrive in its entirety in the coming week.

We welcome continued discussions with I-Forwardtech to address any questions or items they may need in a prompt manner.

On March 19, 2024, I was contacted by a Capital Asset Trader from *** regarding the availability of a JEOL JSM-5600LV scanning electron microscope with accessories. The listing (ID: ********** stated that "spare filaments" were included. After requesting details, *** confirmed via email on March 20, 2024, that the unit came with 48 SEM K-type filaments. This confirmation was a critical factor in my decision to purchase, as these filaments are essential consumables for the microscope, required for its operation, and typically last only 120 hours each.Based on this confirmation, I agreed to purchase the listing for $8,500, including shipping. The invoice (Invoice #********, Order #*********B) was issued on March 20, 2024, and I paid in full via wire transfer on March 21, 2024. *** confirmed receipt of payment on March 25, 2024.Three crates were delivered to my address on October 25, 2024. Upon inspecting the crates on November 2, 2024, I found only 15 filaments, instead of the promised 48, with 9 of the 15 filaments broken. This represents a shortfall of 33 filaments and damage to 9 others, a clear failure to deliver the goods as explicitly described in ***'s pre-purchase communications.I sent photographic evidence of the delivered and broken filaments to CAE on November 2, 2024, along with an email detailing the issue. *** responded on November 7, 2024, stating that an investigation was in progress, but no further updates were provided. I sent a follow-up email on November 22, 2024, which went unanswered. On November 25, 2024, I sent a formal request for resolution, seeking either delivery of ************************** financial compensation of $2,653.36, based on the cost of replacement. I requested a response by December 2, 2024, but *** has not replied.CAEs failure to deliver 48 filaments is a breach of agreement. I seek a resolution in the form of either delivery of 42 functional SEM K-type filaments or financial compensation for their replacement cost.

On 11/30/2023 we signed a purchase agreement with Capital Asset Exchange LLC for a Satisloh 1200 DSL for the price of $35,000.00. We wired the funds to them on 12/10/2023. In January we contacted CAE to prepare the machine for shipment to us. We were at that time told that the machine we paid for was sold to another customer by their client. They said they would have another unit in 2 weeks. We waited 2 weeks and no machine was made available. We asked for a refund in March 2024 and have not received the funds after more than a month of delays. We want the funds wired to our account by April 26, 2024
