I was contacted by this company to purchase my home. Due to recent health diagnosis, I wanted to learn more. After speaking with who I believed to be managers, I decided to sell with a cash offer. I let **** know up from that 3 families items were at the home, that I wanted to sell the home and walk away (again due to health is poor), I let **** know I wanted to close on a specific date but I also had valuable/collectible items I wanted auctioned. **** let me know he had partners to help with the auction of house and truck. **** let me know there'd be a $5,000 hold on funds to ensure I vacated by July 10 2024 closing date. The July 10 date has come and gone. **** and his office person ******* stopped communicating with me. I asked that they respond by close of business on yesterday 07-17-24 but I heard from neither. A gentleman named ***** reached out to me a few days ago making an offer $500-600 additional dollars to me if I'd vacate ALL items prior to August 10 2024. I let him know I didn't believe I could have ALL items removed by then due in part to **** with Bumblebee not keeping their part of the deal. I have both text messages and voicemail to substantiate my claims. Today ****** **** disclosed to me that I'd have to reach out to *****. ***** is a person I believed to be a contractor as he was 1 of 4 people Bumblebee arranged to inspect the house a few weeks ago. After speaking with ***** on the phone today, he stated he can and will wire the $5,000. I offered my banking information but he instead said he'd get it from Bumblebee. After awhile ***** gave my number to someone from his office who wasn't interested in sending the wire as stated. Yet and instead she sent text wanting to discuss what her office understood from the contract. Despite ***** stating over the phone to me that 'we'd ' both him and I were told to varying stories by Bumblebee representatives. I've told ALL parties involved how much additional stress/ hardship this caused. $11,500 owed.

**********, We have communicated with you several times and these are unjust claims. I would like to point out a few things regarding the home. We can start from the beginning, we had a scheduled time to originally meet you at your house. You no-showed us and then one of our representatives was kind enough to drive to the bus stop you were at and give you a ride back to your home to help you out. We do help customers with finding auction companies to help sell belongings in their home. However, after we walked the house it became apparent that the items in the house would not be accepted by auction/estate sale companies. The pictures we showed to auction/estate sale companies said they would not be able to help you. **** relayed this to you and we have this on a recorded message as well.  Our team worked diligently to get your house to the closing table. Truth be told, we will make $0.00 on this deal and we did this as purely a good gesture to help you in your current condition. *****, our partner who is flipping the house has reached out to you to get the $5,000 lease deposit to you after you have vacated the house. However you have still not vacated the house per the contract are not given your $5,000 deposit back until you do vacate by August 10th, not July 10th as you stated, again, this is all in the contract. ***** and **** have both told you this yet you choose to ignore directions and come write a rant on here instead. You are owed your $5,000 upon vacating the house, you do not have to clear the house out if you do not wish to. Just vacate per the contract and you will be released your $5,000 lease back deposit. All of our calls are recorded and if I could share them all here for proof I would.

I am rejecting this response because:  ************ has taken advantage of an elderly and disabled senior citizen. My next complaint will be with them and final to U.S court. The response is full of lies and while Bumble Bee claims to have proof on recorded lines, I too have proof in both text messages, emails and voice mails and I'm 100% sure ANY judge will see the evidence is clear. It's apparent the people I had dealings with haven't done this business very long because they can't make a deal (and it's on writing and voicemail) that they'd get auctioneer for remaining household items but claim after contract that 'they tried'. There's no way a judge will side with their weak evidence. It's clear they took advantage. Additionally,  I have contract with Bumblebee and not the 3rd party contractor they're leaving to return my deposit.  The agreement was to have all that I personally wanted to be removed by July 10, next, the auction items was to happen after July 10 and finally by August 10. The requests from me to Bumblebee were clearly stated in emails and text to which they partly replied (i/e giving me runaround) and others they completely ignored. I finally got a lengthy voicemail from **** stating how he tried to get auctioneers as well as ***** has my 5k deposit. I contend that our agreement wasn't based on 'they'll try'. Nor was my agreement made with ***** and finally Bumblebee asked for last minute meetings for me to open home for their contractors. Bumblebee didn't do their due diligence on this contract and they're allowing me to take the fall. Bumblebee owes me $11,500 for fulfillment of contract and loss of property they will trash. Additional pain and suffering will also be sought after once state court filings.  They should not and cannot take advantage of elderly seniors or any persons who's upheld their portion of agreement.

    **********,
I am sorry you feel this way. These are all false claims as we stated before. You were not taken advantage of. In fact your property was taken on completely pro-**** in order to find an end buyer for your property and truly help you. It is disheartening to see someone turn so hateful after all we did was try to help you and did so pro-****. Holding an auction for your items is not something we do nor agreed to. Again, not sure where you got this idea from.  Please refer to your contract with us as that is what is in writing and agreed to and that is what a judge will review and make his decision based on, especially since we took on the property pro **** to help you but that has completely back fired. This will be our last response and your rent deposit will be released to you as soon as you vacate the property.

I am rejecting this response because:   This organization is not being truthful.  To take advantage of a senior disabled person is horrible. Furthermore to describe my points being made as 'rants and hateful'. It's terrible to know this company does this to the public. I don't know why 'probono' is being brought up as I've nothing at all to do with how they've negotiated business.  I do know that I've 4 more steps to include Age and Disabilities Act, BBB, and Texas Homeowners and finally civil case requested for Human Rights Commision to take for my behalf.  All the evidence is in emails, text and voicemail. So if they're betting on that evidence proving their case, I further question their professionalism.  Additionally, their published reviews from others will be provided to courts. BBB whichever way you find this claim, I'd like to request the complaint be available for public review in addition made available for Human Rights Commision or Age Disablility attorneys to take on my case for the additional monies due and to include pain and suffering.
