Eagle Foundation owner **** voided my warranty after stating that there was a plumbing leak u der my Foundation. There is no evidence and there has not been a plumbing leak test performed to prove this is true. They fraudulently added a pier to there Engineering drawings as it was installed 3 years after the engineer signed off on the work performed. They incorrectly attempted to stabilized the Foundation which has caused bigger Foundation stabilization issues across the home. They incorrectly adjusted the back and side section of the home which left the corresponding windows unusable and un level. When asked to return for survey they stated they would not do so on the day if appointment because they decided to void Warranty due to unproven leak. Now it will cost an additional $5,600 to have another Company correct what there improper work caused. There was not original survey taken to prove why the work was done and what the results from the work were until we noticed the Foundation was unstable

      Business Response

We tried to address all of ************************ concerns, but he was told by someone that everything we did was incorrect.  We intentionally dont level as we dont have access to the original elevations at the time a slab is poured. And the more you lift on the outside the more you risk transferring the load from the outside to the interior.  Elevations were taken before the initial work was done to determine piling placement in the areas of need. Regarding the plumbing leak at the last visit the homeowner told me himself that he had a plumbing leak at the hall bath. I gave him my tunneling contact and plumbing contact phone numbers, for the opportunity to save the homeowner some money off the cost of repairs. I did install a free pile at the homeowners request while adjusting the pilings that were installed prior to ********************** owning the home. The added piling is noted in our records for future reference. There was no charge for that work. The current homeowner told me that he had been told that I should dig up all my pilings and remove shims and then recheck the elevations, which the warranty does not cover and would not be any help as the sloughing of the soils that over the years since original installation, because the soils will work their way under the foundation (sloughing). That would prevent downward movement. We feel ********************** was receiving some bad information regarding his foundation. The drywall repairs made after completion of original foundation work were not done properly as they were taped, floated, and textured and not resecured to the wall studs, so it was a just a Band-Aid repair prior to ********************** purchasing the home.

This is the response from Mr. ************************

I am rejecting this response because:

Let me Clarify the incorrect statements from ************

I am the origianl homeowner from when the original work was awarded to Eagle Foundation in 2016.

There were no original elevations provided prioir to work being completed and there were no elevation reports done until I, the homeowner, called Eagle FOundation to have a survery done for adjustment. At that time, ************************, Eagle Foundation Survey Engr confirmed that there had never been an original survey completed prior to the original work that was completed during the closing of the home purchase in July 2016. He explained that there should have been a survey compelted was confused as to why it had not been completed.

The Second Survey was conducted by *********** in which he clearly saw and surveyed that the backend of the foundation was not correctly stabalized and needed to be adjusted along with the side of the home.

The two man crew provided the warratnty work discovered that there was no pillar installed at the back corner of the house as it should have originally been installed.

The crew installed the missing pillar and did not adjust all pillars as instructed by *********** and *********** confirmed that on the next and final visit.

When I stated that they had addeded the missing ***** and that the crew mentioned they could not adjust any further due to possibly causing a plumbing leak if there was further adjustment on the side of the home. *********** offered his tunneling and plumbing contractors with the discussion that more pillars were needed on the front side of the Home.

When I asked again for the original elevations, the new pillar had been added as if it had been there from original work. When I attempted to call the engineer noted, there is no working contact for them.

When i asked for another survery to plan out a more accurate next set of work, it was then that *********** provided that my warranty had been voided becase of a PLumbing leak that was never proven before or after his last visit.

Simply put, the over and undercorrection of stabilizing aside from there poor craftsmanship work has lead to constant instability of the foundation and has now pushed the issue to area of the Home that was not stabilized.

The only Drywall that is continuosly damaged is on the sides of the home where Eagle foundation originally worked on the Fondation stabilization.

At this point Eagle Foundation has defaulted on there warranty due to an unproven leak condition. The original work is unreliable since there is no valid Engineer that can certify the work and practice actually completed.

      Regards,

      ***************************

I am rejecting this response because:

Eagle foundation was awarded the work as part of the home purchase. Had I not provided a contract, Eagle Foundation would not have been awarded the work.

I've contacted or have attempted to contact the engineer multiple times and ther is no contact.

I personally saw the corner pillars added after the original work that were missing. That resulted in lifting the side of the home that was damaged due to improper pillar placement/installation. Additionally, the method used was not according to the "approved" method signed by Eagle Foundations Engineer. There was only 1 single inverted block driven into the ground topped with 2 side by side pillars and the necessary shims to make contact with the foundation.

I am not concerned with drywall repairs however the constant instability of the work performed by Eagle foundation has provided for continuous drywall repair.

Furthermore, the improper work completed by Eagle Foundation has created more issues across the foundation and will cost additional foundation repair to be addressed by another reliable foundation repair service.

There still has yet to be a plumbing leak discovered

      Regards,
