      I am rejecting this response because:   They still have not responded to the complaint. They told you in their response that they would respond to me directly and I still have not heard from anyone. The check was mailed to the business and has not been refunded. This has gone on long enough with a run around from both this agency and the warranty company.

       

      I do not want this closed until a refund is given to me since they failed to pay for any repairs and gave some lame excuses.

The check was mailed out on 7/29/24 via check #******.       Good morning.  Our ******** office received the check from the home warranty company without any information such as property address or the consumer's name.  We had reached out to the home warranty company numerous times asking for information and did not receive a response by email or phone.  We have since deposited the check in the correct escrow file and waiting for our accounting department to tell us it has cleared so therefore we can issue the check back to the consumer.  The home warranty company was not helpful at all in resolving this issue and not really clear why they did not return the funds to the consumer directly when he cancelled the policy.

      On 9/12/2022 we closed on ****************** to which Fair Texas Title (FTT) was the sellers choice of title company. Part of our contractual agreement was to have a home warranty in place upon closing. FTT mailed a check to Liberty Home Guard 9/13/22 but the warranty company never received funds and the warranty was not started due to non-payment. It was not until 9/26 that I contacted Kelsey at their office to alert them to the problem/issue - all Kelsey did was emailed me a copy of the check. I sent that check copy to the warranty company to verify but payment was still never received. It was not until 10/25 that I alerted FTT a second time that they actually started to correct the error. Finally on 10/26/22 a FedEx check was received and the warranty was active but due to a 30-day waiting period claims could not be filed until late November. From 9/12 (closing) up until todays date we have had to cover repair costs upwards of $8200 due to FTT company not following through on their contractual obligation. Britt F*** as well as their council Chris **** among others have been notified and corresponding documentation has been forwarded to them. At this time they claim this was not their duty/obligation to follow through on. Repair receipts attached - the only one not completed yet is the AC service which we fell this and all other charges/repairs should be covered by FTT due to their negligence and inability to follow through on obligations.

      It is true that the home warranty company did not receive the first check that was mailed to them. We remedied this, as Mr. **** acknowledged. We are not responsible for the expenses incurred by Mr. **** before the start of his home warranty coverage.
