    I am rejecting this response because:   The business is actively suing me to silence valid experience. Please do not close until there is a judgement. We intend to take this to jury trial. I could not have known that they filed the case against me until I was officially served as I was on 3/27/25 but I made this complaint on 3/19/2025, which coincidentally is the date the order was signed by the courts. The case filed against me is a gross misrepresentation of the facts.

    Please see the attached letter in response to this "Complaint."  As discussed in the attached letter, this complaint is false and Ms. ****** has been engaged in a campaign to defame Spenga, which has resulted in her being sued in federal court for trademark disparagement.

    Spenga has nothing else to add.  The lawsuit speaks for itself, and the facts alleged in it are all direct quotes from Ms. ************* The BBB should dismiss this complaint rather than give Ms. ****** another avenue for her to continue to defame the brand and harass the franchise owner for something the franchise owner had nothing to do with.

    I am rejecting this response because this business continues to try to suppress my First Amendment right to speak truthfully about the experiences I had at their location. Ongoing litigation is not a valid reason to dismiss a BBB concern. The companys attempt to use legal intimidation does not change the facts or invalidate my right to file this complaint.

    Their counsel can expect a formal response to their lawsuit soon, along with counterclaims. We will not be silenced by bullying tactics, and we will not allow the BBB to be used as a platform for that suppression. My speech is legally protected under the First Amendment as protected speech, and this companys attempts to punish me for that are both unethical and, in some respects, unlawful.

    I have submitted screenshots and evidence with my original claim that support my statements. The business can continue to deny my allegations, but they cannot erase the proof Ive already provided.

    If possible, I request that the BBB assist in mediating this issue. However, if the business refuses to acknowledge wrongdoing or engage in good faith, then this will likely remain an unresolved complaint. I stand firmly behind the solution I proposed, and will not accept anything less.

    Furthermore, I have strong reason to believe that an individual named ********* may be the one responding to these claims, based on the inflammatory language and tone used. If thats the case, it raises additional concerns about the professionalism and conduct of this business.

    This company should strongly consider withdrawing their lawsuit before it escalates further. Their decision to pursue aggressive legal action against customers appears to be part of a broader pattern, which can be verified by looking into how many lawsuits they are involved in both as a plaintiff and a defendant. That pattern speaks for itself.

    Again, I stand firm in my position and my right to speak out. I will not be bullied into silence.

    Im confused why it says this place has only been open less than 6 months. They opened in 2021. Please give them the rating they deserve based on my complaint.

     

    They may not have had a BBB page but they definitely opened in 2021 which means based on the non-resolution of my complaint they should have a BBB rating.
