    We believe some things were done incorrectly and the title company and broker are refusing to help rectify or at the minimum refusing to help us understand how the process makes sense and was ethical. In a nutshell funds were dispersed during our closing that were less than what we were shown on our HUD settlement. After the fact, I was told our mistake we forgot to add commissions. The issue is I had an agreement to not pay out commissions to the agent who was helping us. Theres more to it but thats the gist. I tried resolving through the broker and he verbally committed to paying us back her commission ($900) but has since avoided my calls/emails. Ill add there is no sales contract between the realtor and I as it pertains to this particular plot of land.

    My apologies on not responding earlier but our office never received the first complaint notice from your office. 

    Our office received a Contract (see attached) on February 28,2023, which showed Seller was represented by *************************, an agent for *************** Company and the Buyer being represented by *******************, an agent for Re/***************** Realty.  In ***** the standard real estate commission is 6%, whereas, Selling agent receives 3% and listing agent receives 3%.  In this case,all parties signed and agreed to a 6% commission which totaled $1,800.00.  We received the order on February 28 and closed the transaction on March 14th with the Seller ******* the closing process.  One of the employees emailed a Settlement Statement and inadvertently left off the real estate commission.  Once she was made aware of the error, she provided the Seller (************************* and her husband) with the revisions.  The Seller returned the signed documents and we disbursed accordingly.  After disbursing funds, *************************, made contact with our office and told us we were not at fault but blamed her agent for everything.  She then contacted her agent and blamed us for everything.  She even stated that the other agent did not deserve a commission. I feel like we did not do anything negligently and we did follow the Contract in which ************************* signed and agreed to. It is not a business practice of an agent to conduct a closing for a client without being compensated for their services.  I have been in business for a very long time,and I have never had a complaint filed against Gainesville Title Company.  Our office works very hard and professionally to take care of our employees and I do not see where we could have been at fault.
