      My brother went to a dealership to look at vehicles. They ran a credit check for both him and my mother, but since my mom was unable to proceed, they called me to see if I could help. I want to clarify that I had not spoken directly to anyone at the dealership. Over the phone, I informed my mom and brother that I was okay with a soft pull to see if I was even an option.I called to file a complaint and spoke with the manager, ******. He mentioned that my information had been entered through a link or app and insisted that I had entered my information myself, which is false. He then claimed that my family had inputted it. However, I knew this was untrue because I was on the phone and could hear the questions being asked while someone was inputting the information. The manager stated that entering my information was sufficient authorization for them to run my credit report. I find this statement shocking! The dealership did not disclose that they would perform a "hard pull" on our credit before doing so, which violates the Fair Credit Reporting Act (FCRA). They are legally required to obtain explicit consent before checking someone's credit history in a manner that impacts their score. The dealership claimed that when you fill out the application, it warns you of the hard pull. The issue is that neither my brother, my mom, nor I filled out the application online, so we were not aware of the hard pull.He said that when I came to get a copy, he would have the police there so we could file criminal charges against my family for using my information. I let him know his cameras would show that his employee filled out the application under false pretenses, claiming it was for pre-qualification and only a soft pull. So, even after all of that, instead of acknowledging the flaws in their process, they threatened us with the police. I called the police, who confirmed it was a civil matter and advised me to file a complaint with the BBB and TxDMV.
