12/19/2024 *********** in question arrived to repossess a vehicle from a deceased individuals property resulting in extensive damage to the driveway. The loan company had been informed of Barbaras passing as soon as it occurred and the loan company had been provided with the contact information of who was legally authorized to handle all affairs post-mortem. NO contact was attempted to arrange to obtain the key for the vehicle or to make any inquiries. Rather, the vehicle was repossessed by dragging it off of the property without entering the vehicle, resulting in significant damage to the deceased persons driveway/yard. The driveway will need to be resurfaced at the companys own expense as proper notification was provided of Ms. ***** passing AND appropriate contact information for any arrangements to be made were provided. This was completely avoidable. The authorized representative handling Ms. ***** affairs has tried to contact the repossession company but has not received a response or any attempt at a resolution. Someone said they would call back but has yet to do so.Business Response

Primeritus has reviewed this complaint and according to our case notes, an agent reached out to the consumer on 12/14 and again on 12/16 leaving voicemails to arrange pickup. Primeritus response has indicated that contact was made on 12/14 and 12/16. ******* Lone had passed away on 12/6/2024 and the company had been notified shortly afterwards along with being provided the proper contact information of the designated trustee authorized to handle Barbaras affairs. This company is continually calling, leaving messages and hanging up. I have also been informed this company is attempting to contact friends, family and associates - some of which I barely know. I have asked this company in writing to put in writing why they are attempting contact and that we would only respond in writing. They have been provided the correct address to send correspondence. They need to cease and desist telephoning myself, associates, friends and family and correspond by writing. I am requesting that this company cease in contacting myself, my family, my friends and any and all other acquaintances related to me. I am recently disabled and as such am in the process of repairing my credit and this company calling will not help, but will instead add undue stress which will hinder my progress. This company is calling people that I barely know to try and get information about me. It's kind of scary and I'm not even sure how they are getting information or why it seems they are contacting friends I have barely any contact with or calling my family! Almost like they are scouring ************ but it needs to stop! My friends and family do not need to be involved in any personal matters nor will they give a stranger information on how to track down a single woman, living alone. This company has been calling and texting my phone during the work day, even after work hours. The voicemails never make any sense, one of them sounds like the person was eating while talking? This company is contacting myself, family members and place of employment regarding a vehicle which an arrangement has been made with the lending bank to be paid in full. Their attempt and/or others either employed and/or contracted by them to repossess a vehicle that is not theirs has been harassing and abusive to me as a consumer, pursuant 15 USC ****d. Also they are in violation of 15 USC ****e. They claim they are not a debt collector but pursuant 15 USC ****a(6) states, The term "debt collector" means any person who uses any instrumentality of interstate commerce or the mails in any business the principal purpose of which is the collection of any debts, or who regularly collects or attempts to collect, directly or indirectly, debts owed or due or asserted to be owed or due another. Pursuant 15 USC ****a(5), The term "debt" means any obligation or alleged obligation of a consumer to pay money arising out of a transaction in which the money, property, insurance or services which are the subject of the transaction are primarily for personal, family, or household purposes, whether or not such obligation has been reduced to judgment. The repossession/collection of the vehicle is a collection of debt. I have not given anyone permission to share and use my information in regard to this alleged debt. If anyone communicates with me and/or my family and/or workplace again, as well as attempts to come to or on mine or my families property as well as place of employment I will pursue with legal action.
