      I entered into a contract on or about May 22, 2023 with Dura Pier Foundation Repair for foundation work on my home for a total cost of $8,700.00. The work was performed June *****, 2023. The Agreement was to install 16 exterior Dura Lock Pilings around the house with adjustments made to the foundation after the house settled. Several months later after the house settled, I noticed a few doors that were sticking in addition to settlement noise. The burglar bar door leading to the backyard through the garage became impossible to open due to the settlement. I contacted Ms. ****** ******* in November 2023 to arrange to have the foundation adjustments done as agreed to in the contract. The first available appointment was on January 12, 2024, Mr. ******** ******* inspected the foundation issues reported and prepared a proposal to add 12 additional pilings for $7,850.00. I contacted Ms. ******* about the number of additional pilings and outrageous costs to repair the issue. On January 25, 2024, Mr. **** *******, Assessment Manager came to re-evaluate the issues. He sent me a proposal to add 4 additional pilings for $2,750.00. Again, the company representatives refused to make any foundation adjustments without me paying for additional pilings. To this date, no adjustments have been made to the foundation as agreed to in the contract. I have only gotten numerous reasons the adjustment to the foundation will not resolve my problems. As of today, the foundation has gotten worse around the entire house with gaps between the window frames and wood trim on the exterior. The house now has gaps above the interior doors along with them sticking when closing. Also, gaps between the bricks all around the exterior. The gaps between the exterior wood have led to wasps building nests between these gaps. I would like to get the BBB's assistance with possible mediation to get this company to honor their contract and to correct all of these issues with my house.

      I received this same notice by mail today 10/29/24 and I called and left her a voicemail.  I will try to reach her again as I would like to discuss a path forward. We installed piers on her home and another portion of her home has settled which is quite common.  The contract she signed explicitly states this as a possibility.  Unfortunately to address this she needs additional piers.  Adjusting existing piers will not solve the issues she is seeing.  We have gone out to her home twice and taken elevation readings documenting this.  We have offered her two solutions ourselves, and recommended she hire an independent Engineer if she disagrees with our recommendation.  If an Engineer believes adjusting our existing piers will help her then I am more than happy to send a crew out.  I will call ****** again tomorrow to discuss this.  If she knows which piers she thinks need adjusting I am open to sending out a crew to do that as a show of goodwill, but I don't believe it will help her at all and could make things worse.  I will also offer her mediation through the BBB, but I'm confident we can work together on this.

      The response from Dura Pier Foundation Repair is deeply troubling, and a grossly inaccurate assessment of the foundation issues. To be clear, the foundation damage is not specifically confined to the portion that didnt have piers installed. As I have repeatedly reported to this company, my entire house has not only settled, but is sinking into the ground causing extensive damage. The majority of damage is where the piers were installed. Failure to make adjustments to the piers early on, which the contract states they would do, has caused these foundation issues. The damage to my house started right after the piers were installed and continues to get worse. I questioned the need for 12 additional piers so quickly after the initial work was done. I entered into this contract 5/22/23 in good faith believing their initial assessment to install 16 piers for $8,700 would take care of my foundation issues. However, six months later in November 2023 my problems began and the house started sinking into the ground.  On 1/14/2024 the new assessment to install an additional 12 piers totaling $7,850.00 with no adjustments to the initial piers.  I can only conclude that one or all of the following has occurred, all 16 piers were installed improperly and have failed, the initial assessment done in May 2023 was not done properly, the assessment done on January 2024 was not done properly, or this is an attempt to extort money from me. I will hire an independent engineer and reply to the BBB with the recommendations within the time frame allotted for this complaint.

      I have called the home owner twice, left two voicemails and finally emailed her.  No response to any communication has been received.  More than happy to work with her, but it looks like she is doing the best thing which is to hire an Engineer to do an assessment.  We have always honored our work and will adjust any piers as needed as they are under warranty if the Engineer disagrees with our assessment and believes she only needs piers adjusted.

      As recommended by the business in a previous response from them, I have the option to hire a structural engineer to evaluate my foundation issues. I have decided to move forward with this option. I am in the process of hiring someone now, and will respond back with their recommendations.  Also, I have received several calls and an email from the business in an attempt to resolve the issue outside of the BBB, which I am declining at this point. I prefer to allow the BBB process to move forward in assisting to resolve this matter. Again, I will follow up once I receive the report from the structural engineer, which will be within the next week or so.
