      I am rejecting this response because: only one thing is factual by David. First of all his dates are completely wrong. Flood happened July 2022, we agreed on Palafoxs bid many months later as the project didnt even start until March of 2023. When we were told it would be 2 months. So we got an ****** for those 2 months which we had to extend another month since David was the only bilingual one and who travels often, plus he had a plumber and electrician walk out on him. Then we moved back in mid June 2023 and still went another month without a kitchen. The foundation was done in October 2022 and was on the complete opposite of the house. Since David thinks he knows everything we had the foundation come out 3 more times from April 2023- sept 2023 to get measurements and they say the house is in perfect condition. Despite Davids efforts of listening to his paying customer, he refused and which is why he kicked 2 people off our project and we have recording of him acknowledging ALL their s**** *** and damages caused to floors, and provided a punch list that his employees created but yet only did 2 things on the list of 20 in a matter of weeks. So yes by month 3/4 into the project I was ***et bc we had a baby and its expensive and hard to live out of a bathroom sink. His cabinet guy also brought a tick infestation into our house. His cabinet guy also complained how David works them to death but never around to manage the projects. David and ***** both said they did not want to pull permits as it wasnt needed. David is correct on one thing, I dont know about construction, thats why Im not in that industry and they took full advantage. ***** and David also denied my numerous text messages asking if they have a structural engineer and me asking for proof that his sub contractors are licensed as I saw different faces every time I showed up to the site. The sagging in the ceiling happened AFTER we moved in. I had to pay for a structural engineer after David sent me a defamation lawsuit. Apparently he doesnt like it when honest and factual reviews are made about him. Why I know he has his lawyer send letter to anyone who gives negative feedback. He also never showed proof of insurance - is he any insured now or at that time? Or is that another lie. The structural engineers Report that is attached also calls David out on his truth and states where its been ruled unsafe due to inadequate support and/or proper supplies due to Palafoxs work. BBB needs to investigate their created business before allowing them to ruin peoples lives. The foundation was done near beam 6 which the report shows no issues. Also, Im not a genius but foundation does not cause Sheetrock and beams to be unleveled in the ONE room they removed a large fireplace and 3 walls. My husband can also testify that Davids response is in fact false on many parts. If David has insurance then this would be settled but it sounds like false advertising and lies to me. My current contractor even stated that if David would have invested in $7.34 in proper brackets then one wood wouldnt be almost snapped. If I could add more videos and photos this would be much simpler.

      and then the ceiling starting to cave downstairs. They refused to DO anything after I paid them $80k. REFUSED to hand over insurance (who knows if they are actually insured). Then David had the audacity to sue me for defamation when HE had HIS friends or employees PM me asking who I was talking about when made a ******* asking for structural engineers to come check. After $10k in lawyers and structural engineers who confirms in their report there are major defects due to load bearing walls not being removed properly and/or improper support. Hiring Palafox was the WORST decision ever and now Im having to pay $68k to fix what Palafox couldnt do bc they are clearly inexperienced. If they cared about ethics, providing good quality service etc then Palafox would have done the right thing and simply fix the unsafe structure of my house that was perfectly safe before they started construction. My lawyer gave them an option to fix it and they declined. I trusted this company.

      In response to Kassi's concerns, I would like to clarify the situation. Initially, our Vice President, *****, visited Mrs. ***** on September 26, 2022, to assist with her water damage claim within the parameters of her insurance policy. However, Mrs. ***** requested extra work that was not covered by the policy, which we agreed to provide an estimate for. This additional work involved removing a wall and installing additional supports. During our assessment visit on October 28, 2022, I noticed a noticeable sag in the living room. While Mrs. ***** mentioned it had always been like that, I emphasized the seriousness of the issue, warning about the risk of potential collapse. She assured me they would address the foundation issue before proceeding with our project. I explained that fixing the foundation would not resolve the problem, as it was related to the second story. Therefore, we recommended involving a structural engineer. However, concerns about the additional costs arose when the estimate was provided, prompting discussions about the budget. We suggested a site visit with the engineer to determine necessary supports in three locations, a proposal Mrs. ***** accepted. Upon further inspection, it was determined that additional supports were needed in two more areas, leading to increased expenses. Despite the extra work, challenges arose towards the end of the project when ***** began making unreasonable demands and imposing strict deadlines. As the project approached completion, she contested payment items outlined in the initial quote, requesting more documentation than agreed upon. Tensions escalated due to the requests for additional information, causing delays and disputes over the final payment. Consequently, communication became strained, resulting in a pause in services due to uncertainties about payment. After a period of no communication, a reminder was issued, triggering a strongly-worded response from *****, threatening legal action. Subsequently, legal measures were taken to address the outstanding payments, leading to negative feedback on social media platforms that disparaged our company and persistent harassment at all opportunities. All accusations made were based on her beliefs rather than facts. We attempted to close this matter with *****; however, her lack of understanding made it challenging to work with her. It is important to note that we worked on a home built in 1979, and issues only emerged when it came time for payment. Therefore, we cannot take any responsibility for refunding her.
