May 10, ************************************************************* contract.Invoice #****-42324H dated 4/23/2024 I contracted with Acorn Outdoors to hand plant and spray 18 acres of pine seedlings on July 24, 2023.Acorn planted the seedlings on February 18, 2024.Included are two invoices for seedlings and hand planting, and they were paid. That part of contract is not under dispute.Acorn sprayed the seedlings on April 15, 2024. Time on property was 3 hours.A crew is 12 men + supervisor = 13. Spraying man hours is 3 hours x 13 men = 39.Spraying labor cost at $58.00 / man / hour = $2,262 However, Acorns invoice lists Quantity 84.5 rather than 39.Broadcast Herbaceous Weed Control Hours **************** 84.5 In the included email exchange, I asked about the billing Quantity discrepancy.*********************************** responds Acorn is also billing for drive time of 3.5 hours Lufkin to ********That is, driving 3.5 hours x 13 men = 45.5, is billed as Broadcast Herbaceous Weed Control. This additional billing of 45.5 x $58 amounts to $2,639.The agreement has:Phase IV Herbaceous Weed Control- Hand Application Driving time is not mentioned anywhere in the contract, only weed control labor. Its also odd they are billing driving hours from Lufkin to *******, but not Bastrop to Lufkin. They seem to be winging it, deciding what to bill after they spray. The time to disclose costs is at bid proposal and contract time, not after work has been performed.I could have decided to have a local firm spray, or not spray at all. The contract I signed has no mention of drive time billing for weed control.I am seeking to reduce $5,096.73 billing by $2,639 amount to $2,457.73 I have not submitted payment for this invoice. Thanks
