    On 9.18.2022, I visited Benders and upon checking out noticed there was a discrepancy between the amount presented on the bill and the amount presented on the debit/credit card slip after my debit card was run. I had visited Benders 29 times prior to this visit and never before noticed a discrepancy but that's because, never before, had I been given the check back with the debit/credit card slip after my debit card was run, which I had consistently found odd and irritating as I do not like to tip on tax. I asked the server about the discrepancy and she informed me it was a credit card convenience fee. When I informed her, that in Texas, the business must notify the consumer of such a fee prior to payment, she said she'd "get Josh." Josh comes out of the kitchen yelling at me that it's not illegal, that bars all across Dallas are doing it. I asked him for a refund and he said no and I told him I'd like a refund on my card so I could pay cash. He obliged. In this instance, the check amount was $13.31; however, the amount charged to my card was $13.88, a $0.57 difference or 4.28%. I pulled all my Benders transactions from QuickBooks, which is how I know I had frequented Benders 29 times prior to this visit, and those visits totaled $1,018.74. On all these prior visits, I was charged a credit card processing fee without my knowledge. Based on today's transaction, I assume the fees assessed in the past were 4.28%. So, presumably I was charged $43.63 in credit card processing fees without my knowledge and I'd like to be refunded those fees. I'd also like Benders to notify consumers of such fees going forward so the consumer may make an educated decision with regard to method of payment. Personally, I never conduct business where I must pay to pay and certainly wouldn't have frequented Benders more than the first visit had I been properly informed.

    Benders has it posted at the door when you walk in at both locations and its on your receipt. The Fee is not 4.28% it's 3.85% your math is wrong. We will not be refunding you for past visits because there is no way for us to verify how many times you have been in and paid the service fee plus we feel its your responsibility to review your bill before paying. I have uploaded a picture of the notice and we have gone an extra step and posted it at each register.
