    ******** called me on October 30, 2024 stating that our current credit card processor was overcharging us. We should be on a wholesale rate and always be under 2%. She told me that if we don't like their services we can switch back to our old processor no problem. Never mentioned a contract or early termination fee. We got our first full month invoice in December and our rate was over 3% (over 4% with start up fees). I emailed their customer support regarding the ******** telling me our rate would be under 2% but it was over 3% and ******** ***** replied back saying this: "She has you at the low rate. The interchange fees and pass through fees are set by the card association and we cant change those. Do you guys do a lot of keyed in cards? If you do, to keep that cost down youll want to enter the ccv and address when it prompts you for it. Do you guys take a lot of reward cards?" When we set up the account, ******** was informed that we only do keyed cards. We enter in all the information that is asked and our rate was no where near the 2% or less. We sent a letter terminating our contract but they are saying we have to pay an early termination fee of $495. I believe we should not have to pay the early termination fee when I was blatantly lied to by ******** **********************).

    We contacted Ms. ****** regarding her concerns.  We did explain that there was no way to effectively guarantee what the actual cost per transaction would be due to the fluctuating nature of card acceptance and the range of cost assigned to various interchange rates.  In a good fatih effort to satisfy Ms. ******* we agreed to close the account without financial penalty. Ms. ****** stated that she was satisfied with thiis resolution.

    I was contacted by Datalink and explained what happened. I was told they will waive the early termination fee.
