    Cruising Kitchens, LLC has a box truck in their possession that is owned by Haven Campus Communities, LLC. They will not allow me or anyone else to view the condition of the truck until the receive $10,000 in fees for storage that was never agreed up or signed in a contract. The fee they charge doesn't match up with their e-mails on amounts due but they will not negotiate. I am concerned they have parted out the truck or have modified it for their own use and will not return it.

    The comments and statements that the complainant is making are false. His colleague acknowledged and agreed to pay for the storage fees as you can see in the attached emails along with the paid invoice and receipt for partial storage of the truck. We did not deny him access to the truck. In fact, the President of Cruising Kitchens invited him to come to view the truck in person to show that the truck was in the same condition as they left it. However, we did inform him that we could not have any other conversation with him until the agreed-upon invoice was paid. The original invoice did have an incorrect amount but was then later updated and recent to reflect the true amount owed. There has been little to no communication between his company and ours which has led us to believe that they have forfeited the rights to their truck. Although we have not yet pursued it, we as a dealer and manufacturer have the authority to place a lien on a vehicle when the owner shows no sign of reconciliation.

    I am rejecting this response because of below.

    1. This company is not licensed to charge storage fees in the ************** per attached compliant. 

    2. Invoice #**** attached by *********************** related to previous work done by the company before the invoice in question #**** for $10,000. There was no work done on the truck for invoice #**** in question.

    3. The e-mail attached from *********************** stated that the invoice wouldn't be charged until July 2022 but invoice #**** starts billing in February 2022. There is no further e-mails forwarded to me from *************** or anyone else from Haven Campus Communities, LLC agreeing to this $500 monthly rate from July 2022 forward.

    4. I offered to settle for $2,500 but the owner has refused to negotiate. 

    5. This company builds Food Trucks so we are concerned the vehicle has been damaged, parted out, or altered for their use and they said they will not allow us to view the vehicle until invoice #**** is paid.

    1. As both a manufacturer and dealer, we have the right to place not only a construction lien on a project but also a mechanic's lien. The client has no proof other than his own complaint stating that we are not allowed to do this. Basic research would show that we are in our right to do either one of the two or both.

    2. Attached is the invoice that was adjusted based on the client and company agreement for storage fees. The client refuses to comply with their agreement and has not paid any amount towards the invoice.

    3. The invoice was adjusted and resent to match the original agreement.

    4. Although the client offered to pay $2,500.00 towards the invoice, this is only 30% of what is owed. We tried multiple times to have the client pick up their vehicle so that they would not incur storage fees but there was a large lack of concern from there end about the vehicle. We are no longer willing to negotiate based on the client's threats to go legal.

    5. We did not refuse any type of access to the truck. We simply stated that a conversation needed to take place before the keys were handed over to them. There has not been any damage or modifications to the truck other than normal wear and tear from weather elements and from sitting in one location for over a year.

    I am rejecting this response because:

    1. Cruising Kitchens is not able to legally file a mechanics lien in the ************** because no repair work was done or agreed upon on the truck and there is no written contract. The only thing that my client Haven Campus Communities, LLC is being charged for is storage fees. This is common knowledge in the automotive business and we are sure that this company has been told such from any person trying to file a mechanics lien for them.

    2. Cruising Kitchens does not have a VSF license in the ************** which is required to hold a vehicle in storage against the owners wishes. We expect that this is because the owner of Cruising Kitchens, LLC whose name is *************************** is a convicted felon and is not legally allowed to obtain such a license. We are following up with our formal complaint with the ************** now. This type of license requires extensive insurance and drug testing of employees to ensure things like this don't happen.

    3. I have tried multiple times to try to get a mobile mechanic to look at this truck and have not gotten a response on a date and time when to look at it per attached. My clients are concerned at this point that the truck has been parted out or sold in a "chop shop" operation especially considering the owners criminal background. If BBB could help facilitate us looking at the truck to make sure this isn't the case my clients would appreciate that as it would deter my clients wanting me to file a police report in regards to the truck being stolen by an unlicensed shop.

    4. In spite of all of this my clients are still open and available to settle for $2,500 in storage fees which is all the money that can paid after selling the truck wholesale. This offer is good only after a mobile mechanic looks at the truck to make sure it hasn't been parted out or sold and would be paid on the day it is shipped out. This offer will be good today or next year unless the trucks title is still is sold or transferred by court order to a creditor of the company. I am prepared to put together a contract stating these terms which are non negotiable at this point. The only other alternative would be if Cruising Kitchens is interested in buying this truck title and selling it themselves. If they want to make me an offer then I can run it by the owners of Haven Campus Communities, LLC to consider. This trucks wholesale market value if working and minimal repairs are needed is $15K and I could forward my buyers information to Cruising Kitchens if they want to sell directly.
