      I have a loan with Ovation loan # **********, i have had it for several years. I have made years of monthly payments along with large amount payments, ****** and *****. I have asked for pay off, when I received it,didn't add up, so i requested an itemized payment history. I received 3 different ones, none of them matched nor added up. none of them showed all of my payments nor exactly where my payments went. to principal, interest , late fees nothing was itemized. And the dollar amount they showed monthly the whole monthly payment was not accounted for. I have sent certified packages to ********* on 2-26-2025 and to ********** office on ********** both were signed for. Before that I have called many many times trying to reach a manger and was always told she would call me back, not yet. I called spoke to ***** ******** 4-22-2025 at 1:37 pm he said his manger would call me the same day, nope not yet. I have called several times since then no return calls. they don't even pick up go to Voice mail. Oh when i have told people there the manager hasn't called me they say well here in our notes she said she tried, well I'm telling you no....I have asked for a full audit of my account, a loan amortization which show how much my loan was for my interest rate and how much of payment went principal and to interest. but to date have not received anything. I sincerely would like to clear this up, so I may pay my loan off and release my property. From what I see looks like fraud is happing, they continue to hit me with BS lawyers fees and what ever other fee they can do. To me they are doing some fraudulent acts. Again I would like to know where every ***** I have paid where it has gone to . Which by law I have a right.       We are writing in response to BBB Complaint #********, and we sincerely apologize for the delay in providing a clear and full explanation of your loan account. We appreciate the opportunity to address your concerns directly and respectfully.

      Your loan with Ovation originated on April 18, 2018, in the original amount of $25,640.85 at a 13% simple interest rate, with the first payment due on July 30, 2018. The loan number is **********.  We are providing you copies of your Tax Lien Contract and Repayment Agreement.  As of the date of this letter, the current principal balance is $12,746.98.

      In response to your inquiries with our ******************** directly, we have provided the following documents:

      1.  Borrower Statements of Account These are system-generated overviews showing the loans progress, including balances and total activity.
      2.  Borrower Payment Statements These detailed reports show individual payments and how each was applied toward principal, interest, or fees.

      These documents are generated from different areas within our servicing system platform and serve distinct purposes, which can lead to differences in layout and presentation. Although the formats may vary, both statements draw from the same underlying account data and accurately reflect your loans payment activity and status. Any perceived discrepancies are related solely to how the information is displayednot to how your payments were received or applied.

      We are providing copies of the 3 Borrower Statements of Account that we provided you previously.  They are for December 2024, January 2025 and February 2025.  We are providing copies of the more recent Borrower Payment Statements, that you would have received monthly by email.  They are for January, February, March and April 2025.

      We recognize the multiple requests you have made and understand your desire for a clear and complete account history. A portion of your loans historical dataspecifically payments made on or before March 1, 2024was stored in a prior servicing system.  Your loan was serviced using the **** servicing system from inception through March 1, 2024.  On March 1, 2024, your loan was migrated to a new servicing system, known as TMO.  The statements previously provided were for transactions from TMO only.  For clear visibility,we are providing the full transaction history from ****, which is the ****_Payment History_Charlene Gardner_********** document.  We are also providing the transaction history from TMO, which is the TMO Loan Master Report ********** document.   

      Payment Review and Verification

      With the transaction history from **** and TMO, we have carefully reviewed your full payment history. All payments were received and properly applied according to your loan terms.

      To confirm accuracy, we used a simple interest calculator (an Excel tool outside of our systems) to verify how each payment was allocated to principal and interest and to confirm it was applied correctly. The attached itemized summary (see ********** ******** D ******* Simple Interest Calculator) clearly outlines:

      1.  Date and amount of each payment received
      2.  How the funds were applied
      3.  The updated balance after each transaction

      We also reviewed your account for any charges beyond your standard loan terms of principal and interest. There have been no unauthorized or unexplained fees applied to your loan. Any fees that appear on your statements are consistent with the loan agreement and have been disclosed accordingly.

      We understand the frustration expressed regarding your efforts to reach a manager. Our internal notes reflect multiple documented attempts to return your calls, but we acknowledge that a successful connection did not occur.

      We are committed to resolving this matter transparently. To that end, we have:

      1.  Attached a complete payment reconciliation via the simple interest calculator
      2.  Verified all account activity and current balances

      We are the current owners of a home we have under contract for sale. However, we were unable to close because the title search found that loans from Ovation Services, LLC (or their affiliate) with liens against the property the previous owner made had been paidbut when Ovation Services, LLC filed the RELEASE OF LIEN (Doc#***********) for the loans, the document failed to account for two TRANSFER OF LIEN (Doc# *********** and Doc# ***********) recorded in ******************** which should had been included.I called the customer ******************** who immediately validated that the account(s) were paid of. Then they contacted (I suspect via email) the department or person that should prepare and provide the updated or new Release. After six calls later, several emails from the title company as we as myself and two weeks later, I still get the same running around by that department. Im addressing the matter in this review hoping to catch their attention so we can get the Release, clear the property record and close the sale. This matter forced us to delay the closing and poses potential withdrawal from the buyers. Therefore, further delays could cause the lost of the customer and could force us to consider other options due to the business loss.The loan(s) debt was satisfied and paid off more than 5 yrs ago. The release the company provided and recorded failed to reference the two documents below associated with the transfer of the liens tied to the paid off loans. The home is under contract for sale and the clouded title is delaying the closing. This delay is impacting in a way of loss of revenue due to extended expenditure which we are incurring every day the closing is delayed. THESE DOCUMENTS (Doc#*********** and Doc#***********) ARE CLOUDING THE ***** AND PRECLUDING CLOSING. Ovation Services, LLC has confirmed the depth is satisfied so this matter can be resolved by providing a simple release and 27 days later, were still waiting for it.

      We sincerely apologize for the delays and challenges you experienced in getting this matter resolved. We appreciate you reaching out and want to acknowledge the frustration this situation has caused. You made multiple calls and sent multiple emails to get this resolved, and we recognize that despite your persistence, the issue remained outstanding longer than it should have. We sincerely apologize for the lack of clear communication and the delays in addressing your request. We should have handled this more efficiently, and we regret any inconvenience this has caused. 

      Part of our challenge is that the original Release of Lien (***) was completed in years past by a former Servicer, Ovation Services,LLC.  We took over the servicing of the portfolio on January 1, 2024, as ************************** dba Ovation Services.  Prior records were not always readily available for our use.

      After finally reviewing the prior records and reviewing your concerns, we have now included all referenced documents that were affecting title clearance. Specifically:

      The Transfer of Lien from June 2014 (Doc #***********) from Sombrero Capital LLC to ************* has now been included and released.

      The Transfer of Lien from June 2014 (Doc #***********) from Grizzley Loan Opportunity Funds to ************* has also now been released.

      We have updated the Release of Lien and sent a copy to you. We are also providing a copy of the *** for your records, as part of this response.  With these updates, there should be no further title issues related to the documents in question. We sincerely regret the frustration this has caused and appreciate your patience as we worked to correct this.       In 2013 I purchased a house from an individual named ******** *****, ******** then took out a loan with propel for back taxes then took out a second loan by ovation services to pay off propel. He never intended to pay propel back nor ovation. Ovation has put a lien on my house and gave me 6 months for me and my children to move out and has forced me to sell my house and give them $ *********. ovation agreed and bought ******** ***** debt. They have his signatures on this agreement! Ovation does not have my signature agreeing to pay ******** ***** debt. For ovations mistake I'm about to be homeless in 6 months. I have paid my house off in 2016 and have been paying my taxes on my home and there for there should not be any reason why I should be forced to sell my house and give them 48.900.00. Mr ***** never intended on paying ovation back and they should go after Mr. ***** not me and my family. I do not wish this nightmare on anyone. I pray for someone to read this and help find a solution to this horrific unfortunate situation for the sake on my children. How can I get this lien removed off my property without having to pay ovation services something that I never signed for. Ovation payed a debt off that did not belong to me and now my family and I our having to suffer the consequences for ovations mistake.

      I took a loan with Ovation years ago when my father passed and property was placed in my name. I was unaware of unpaid taxes and I used Ovation Lending to help with that. Everything was going well up until March 2024 when I delivered a citation from ***** ********* who is the attorney that Ovation Lending uses stating foreclosure on my property for unpaid amount. Yes I did get off track early 2023 however I contacted Ovation and was able to setup payment arrangement for current and past due balance and they agreed on $245 per month via auto pay which started in November of 2023. I have all email receipt where payments were processed each month. So I reached out to Ovation to see what was going on and every person spoke with in April/May of 2024 told account was fine and they were still deducting my monthly payment of $245 on the 15th of each month. But early May get a call from Ovation saying they can no longer process my ach and that I need to speak ******************************* with ***** ********* regarding my account. I called several times no one ever answered and it states to email so I have emails from ******** during this time frame to figure out what is happening and at the beginning all she would say is she has contact Ovation to see why they filed it and Ovation is telling me they didn't file anything. So there was a lot of both companies putting the blame on each other and me not getting a answer. So long story short I asked Ovation for a statement so I could see my balance and they told me they could not send me a statement which no could explain to me why I couldn't get a statement. I found a statement from June of 2022 an the principal balance is still the same on the current payoff statement that ***** ********* sent me. They have added additional attorney fees but yet can't tell me why. So I feel something fraudulent is going on regarding the balance because if the past due was an issue why would they setup autopay and I have done this in the past.

      We also appreciate you taking the time to discuss your account and the series of events with one of our managers.  After he aligned with you, the following steps were taken regarding your account:

      1.  As you paid $492.80 in legal charges tied to the citation from your account, we are refunding you that amount.
      2.  Due to our mistake, we are also sending you a refund for 10 late fees for a total of $65.70.
      3.  We then reapplied your most recent payment, which paid you through July.  Your next payment due date is 8/15/2024.
      4.  As of 6/6/2024, your payoff balance is $7,611.80, of which $7,586.68 is principal and $25.12 is accrued interest.

      In addition, the lawsuit has been dismissed. Your account is in good standing with us.

      I paid ****** dollars for my back taxes am still ending up with a back tax bill of ****** for the country. This company is fraud an needs to be look into. Ovation Service LLC business work ethic is horrible.

      We were able to review your account.  Here is a timeline of events to assist in understanding your loan balance:

      1.  In February 2015, your account originated with a starting loan balance of $45,525.81.
      2.  Since origination, your account has not been paid on time consistently.
      3.  Over the years, this resulted in us having to send legal notices as follows:  December 2015, February 2016, April 2016, October 2016, January 2017, and May 2019.  Legal notices result in legal fees being assessed to your account per your loan documents.
      4.  Separate from your account with us, the taxing entities filed a lawsuit against you in July 2019 due to non-payment of delinquent property taxes.  To protect our interest, we had to intervene into that lawsuit, resulting in additional legal fees.  The taxing entity set the lawsuit for trial in August 2023.
      5.  In June 2021, we entered into a payment plan with you.  At the time, you were past due as of January 2020. 
      6.  As of August 2023, you defaulted on your payment plan with us.  The last payment we received was in April 2023.  We have not received any payments from you since April 2023 and your account remains past due as of May 2023.

      Failure to pay your account according to your loan documents and failure to pay your subsequent taxes owed resulted in additional interest, late fees, and legal fees being assessed to your account, resulting in the balance currently owed.

      In addition,when your account originated, it was set up with escrow services.  The intent was that portions of your monthly payment would be held in escrow with the purpose of paying subsequent taxes as they became due.  Unfortunately, inconsistent payment of your account resulted in no available funds to pay those subsequent taxes.  Lack of funds then resulted in escrow services being cancelled.  This explanation should provide context as to why you state you have a back tax bill of 25,000.

      Ovation Services is a PREDATORY LENDER that has "forced insurance" on my property. Severe weather a few years had created multiple leaks in my roof. I notified Ovation Services and the **************** but the insurance agent informed me that they were going to pay ovation Services and NOT FIX THE LEAKING ROOF. Now, The water damage is so excessive throughout the house it has developed TOXIC MOLD, damaged sheetrock, paint,hardwood flooring and damaged my HVAC system. I notified **********************@ Ovation Services (Attorney) from day 1 but haven't received any help in remediation of this HEALTH CONCERN. Also, I have tried to seal the roof myself but it didn't work.

      Attached is the Deed of Trust that outlines insurance requirement and allows for Ovation to use the insurance proceeds to reduce the outstanding note.
      Next is an email thread involving the borrower that explains the outcome of the claim.
      Also attached are the coverage letters from the insurance company outlining that the damage to the roof is from poor maintenance.
      The screws in the metal roof had backed out and the borrower had caulked the areas to prevent water from entering the home.
      The adjusters photos show no penetrations in the metal roof.
      Neglect and poor maintenance is not a covered peril under our insurance policy.
      The total claim was $1,955.05, with a $1,446.00 deductible, and an additional $227.68 withheld in depreciation.
      This left a final balance of $281.37.
      The claim proceeds were applied on 5/12/2020 to the outstanding as no payment had been made to the loan since 2015.

      Also, per the finance code, we have the authority to place collateral protection insurance. The *** is not considered homeowners insurance for the benefit of the owner, but for the protection of the loan amount.

      I am rejecting this response because: Ovation Services "Failed" to repair the storm damaged roof/walls/foundation with the insurance claim money paid to them and have created a HEALTH HAZZARD to me and my family.

      Ovation Services have also refused every effort to modify the loan.

      Ovation Lending services is a predatory lender for the amount of EXCESSIVE FEES in their unfair lending practices.

      Can Ovation Lending services please upload the original loan contract amount and the current PAYOFF amount???? FOR EVERYONE TO SEE!!!
