On Thursday, March 27th, 2025, while I was not home, ******* Tree Service, hired by my back neighbor, wrongfully cut one of my trees. Although the neighbor had hired them to cut roots that had crossed the property line, Woodys Tree Service cut through the fence and cut into the trunk of my tree without my permission. After the improper cutting, they left the compromised tree standing, and it subsequently fell hours later, creating a dangerous situation and causing damage.Upon contacting ******* Tree Service, they admitted to making the mistake. However, they refused to take full responsibility. I requested that they either replace the mature tree with another mature tree of similar size and species or compensate me for the loss. Instead, they dismissed my request, stating that the tree was a "wild tree" and therefore "worthless." This is not acceptable regardless of the type, the tree was living, on my property, provided privacy and value, and was wrongfully cut down due to their negligence.

    Business Response

    Date: 06/02/2025

We appreciate the opportunity to respond to the concerns raised in the complaint dated March 27th, 2025.
Woodys Tree Service was hired by the complainants neighbor to cut roots that were growing through and damaging the shared fence between their properties. Our work was limited to addressing these intrusive roots, which were on the neighbors side. According to Denton County regulations, residents have the right to trim tree branches or roots that cross onto their property.
While addressing these roots, we made efforts to avoid damaging any trees. However, it is important to note that the tree in question was situated directly on the property line. We provided photographic documentation to show the condition of the root and the surrounding area at the time of service. You will be able to see the original root and that was a root that was superficial, and you can see the dimension of the tree.
That same evening, ************* experienced a severe storm with winds exceeding 50 miles per hour. The tree, which had structural concerns and was likely compromised by both age and weather, fell. The complainant contacted the police and our company, alleging that our work caused the tree to collapse.
When we spoke with the complainant, we acknowledged the situation and offered to try and replace the tree, despite the fact that it was a wild tree species not typically sold at nurseries. Our goal was to make a goodwill gesture, even though it is difficult to assign a commercial value to such a tree. Unfortunately, the proposed replacement was not accepted by the complainant.
The complainant then insisted on monetary compensation. Since no objective valuation for the tree could be determinedand we were unable to reach an agreementwe offered to let the court system determine if compensation was appropriate and, if so, how much. To our knowledge, no court valuation or legal action followed, and no further communication was received from the complainant until this BBB submission.
We are committed to resolving issues fairly and professionally, but we believe our actions in this matter were reasonable and in accordance with local regulations and industry standards. We remain open to constructive dialogue should a third-party resolution process provide a clear basis for further action.
    Sincerely,

    ***** ********
