    Date: 04/12/2024

************ contacted Providence Equipment on March 21, 2024, at 9:30 am wanting a freight quote to ******** and a compression test on the machine in question.   The salesman and ************ discussed the mower, and the salesman informed him that a $500 refundable deposit is required by Providence Equipment to consider an item sold and reserve the machine.  ************ decided to wait on the compression test results and freight quote before putting the deposit on the mower.  Because the deposit was not put down, per Providence Equipment policy, the machine was not considered sold.

That same afternoon another customer purchased (deposit was provided via credit card) the mower in question and another mower at almost 5:00 pm on 3/21/24. The mowers did not get pulled down from **** that afternoon. On Friday, March 22nd ************ called the salesman about 9:30 am and wanted to know the results of the compression test and freight quote. The salesman informed ************ the mower was sold (with full deposit) the day before. At that time, ************ went into **** and did the Buy-it-now on **** at 9:40 am and the sale was canceled at 9:47 am in **** because of the prior sale to another customer on March 21, 2024.  Per **** policies, a vendor is not obligated to sell an item to a customer if the vendor does not have an item in stock.  This is one of the reasons for canceling an order and that was why the order was canceled.

The salesman and owner have spoken with ************ explained the situation and apologized for the inconvenience.
