    Complete Healthcare Business Consulting (CHCBC), a women-owned minority business, entered into the Service Order with Domo on October 27, 2023, for certain Subscription and Custom Consulting Services. Before entering into the Service Order, CHCBC informed Domo that they were seeking Domo’s assistance to streamline their Master Fee Schedule (MFS) Analysis, Payor Rate Analysis, and other services. CHCBC and Domo signed a Non-Disclosure Agreement in which CHCBC provided copies of all relevant information, including an outline of the desired product from a reporting and data analytic standpoint. Thus, Domo was clearly aware of the product CHCBC wished to utilize in their business practices and promised they had the capabilities and resources to create such a product in the agreed-upon timeframe.
    The consultant provided by Domo was not available to work until late November due to over-commitment and excessive workload. CHCBC was promised a product template by mid-December. By this time, Domo did not have a template completed as a result of Domo’s limitations and application complications. On or around December 15, 2023, it became clear that Domo could not produce the MFS Analysis in a way that would work how CHCBC intended it to. Even though CHCBC was disappointed with Domo’s inability to produce the product, CHCBC began working with the consultant to create a template for the Payor Rate Analysis. Once again, the product had numerous limitations and workarounds that made it less effective than CHCBC’s current process. It became evident that Domo did not have the resources or skills to produce the products they had claimed.
    CHCBC made its first request for a pro-rated refund on December 15, 2023, and again on January 31, 2024. CHCBC made numerous inquiries about the status of their requested refund, which were unsuccessful. Per counsel, CHCBC has promissory estoppel and unjust enrichment claims against Domo. All attempts for a refund have failed, Domo refuses to refund
