    They put information on my background that is NOT allowed per state law. It is a 7 year look in **** unless the job pays more than ***** a year which is does not so it made me lose a job. I want them to send the company a correct report and stop reporting things from the 1990s which is illegal

    I just spoke with ***** and I can definitely see her frustration as to why an employer would care about a ***** crime that happened over 30 yrs ago when she was just 18 yrs old. As the reporting agency we simply do what our client tells us to do. In this case the prospective employer of ***** asked to see criminal information indefinitely. Below you can see what the reporting laws are in the state if Iowa.

    How far back a pre-employment background check in **** can go is governed by the **** and Iowa law. The **** includes a seven-year lookback provision for jobs that pay annual salaries of less than $75,000. If your open jobs pay less than this amount, the following types of information will not be reported:


    Arrests not resulting in convictions
    Bankruptcies
    Civil judgments
    Civil lawsuits
    Liens
    The lookback restriction does not apply to records of criminal convictions or jobs paying $75,000 or more per year.

    What ***** said about not being able to report criminal records older than 7 years if the applicant is going to make less than 75k is mostly correct. The only caveat to that is if the crime resulted in a conviction. Due to the fact that the crime did result in a conviction then it is perfectly legal to have reported the information. We definitely agree with ***** that it is absolutely ridiculous that the company would care about something that happened over 30 yrs ago. Unfortunately we simply do what our client asks and they ask to see criminal information indefinitely. Now that we have spoken with ***** and explained the additional exceptions in regards to the Iowa reporting laws we kindly ask that this negative complaint be removed from the BBB.
