    Arive Homes caused damage to landscaping and sidewalks due to broken irrigation pipes during development of ************* 55+ Community along Teton Village Dr in ********. The flooding was so bad that the city was called to turn off the water. As a ******************* has sunk around the homes, and sidewalks have sunk and cracked. ************** Manager (******) said that they are not responsible even though the Arive Homes Superintendent told us personally that they would come back in spring and fix the damage. The Arive Warranty Manager said we should contact Wright Homes, who are also building homes in the community, because it is their responsiblity. We contacted Wright Homes about the issue and here is their response: "When Arive homes took possession of their lots, the sidewalks in front of those lots were in perfect condition, and accepted by the City. When ***** took title to those lots, they assume the responsibility for the frontage improvements. Any damages since that time would be the responsibility of Arive Homes." One final note, there are mostly elderly people in this 55+ community and these sidewalks have become a hazard. ***** knows they caused this damage yet they want to totally walk away and leave homeowners stranded.

    In December 2021, the settling sidewalks were noted by Arive Homes to the developer who installed those lots, sidewalks, and utilities.  Unfortunately, Arive Homes did not develope, pour, install utility lines, or any other development that is now failing.  Uncompact utility lines trenches are also failing.  We have reported all the issues when noted to the developer and city.  Wright homes developed these lots and is responsible for there repairs.  Unfortunately they are not responding.  Also, as the developer, they did not install stop and waste valves on any of the homes and Arive Homes had to finish that aspect of neighborhood development to be able to build homes on these lots.

    I am rejecting this response because: Arive Homes should have divulged this information to homeowners before closing and did not. They intentionally hid this information until now.

    As stated in the previous response, these issues are from poor development and unfinished development.  Our ownership team has contacted the ownership team at Wright Homes to warranty their developement and respond to settling in the neighborhood.

    I am rejecting this response because: Until there is a resolution between Arive and Wright homes on who is reponsible for the damage there can be no acceptance of the responses. Up until now all there has been is finger pointing.

    Apologies, as stated before, we have passed the unfinished development issues back to them, ownership to ownership.  Our team doesn't have the ability to control their schedule.  This is not damage caused by Arive Homes.  This is a developer issue, again.

    We met with ****************** on site.  He is aware the settled sidewalk sections are schedule for replacement.  He is also aware Wright Homes will have no involvement in his landscape repairs, those issues are between ****************** and his builder.  We have also corresponded with Arive Homes, they are aware of our willingness to assist in getting the sidewalks repaired, but we won't be involved in any landscape repairs.  Those repairs are between the homeowner and builder of the home.

    I am rejecting this response because: As Wright Homes indicated, this does not resolve the issue with the damage done to the Landscaping by Arive Homes. If Arive Homes takes responsibility for their actions and fixes the landscaping then this issue can be closed. The homeowners appreciate Wright Homes taking responsibility and Arive Homes should do the same.
