The ES Solar panels deemed our tar and gravel roof as solar panel compatible but after they installed the panels, our roof leaked in two places right below where the panels were installed. We called several times and they came to make repairs. One leak was resolved but the other worsened. After 4 years of back and forth, they now say they are not responsible for the hole in the roof and want us to pay them to take off the panels while we pay a roofing company to repair/replace the roof.

      Business Response

      Date: 04/18/2024

      Hello,

ES Solar was notified of the leak and then contacted a 3rd party roofer to complete an assessment of the damage and determine the source of the leak. Per the assessment of the roofer:

"The tar and gravel roof has some rotted plywood around the edges but with all the snow we weren’t able to get a good look at the roof but the sections that we were able to look at it looks like this roof is getting to be toast. Cracking in all of the tar. Once that starts happening, it's a domino effect so it’s just gonna be a matter of slapping tar all over the place (bandaids) until they do the roof. I don’t do tar and gravel just because they’re a pain, to be honest. We could do a membrane roof and land at - $20,450."

We informed the customer of these findings and they insisted ES Solar should be the responsible party for the roof replacement and costs associated, when clearly solar was not the issue in this case.

ES Solar is not a roofing company and is not responsible for the state of the roof prior to the solar installation and expects the customer to be responsible homeowners for knowing the state of their home and roof.

Any leak caused due to incorrect installation of solar equipment, ES Solar would and does, work with the homeowner to ensure fixes are handled and costs covered.

      Complaint: ********

I am rejecting this response because:

I am not asking ES Solar to replace my roof. I am asking that they repair the leak which started (with the first rain) immediately after they installed the panels and continued, with every rain storm and snow melt thereafter for the 4 years that followed. They repaired one of the leaks. They came diligently every time we called but failed to repair the other leak, which leaves a stream of water flowing into my kitchen every rain. By coming at all, they acknowledged that their work was responsible. They admit that the roofing company could not see the source of that leak due to the snow. Additionally, we were assured that our roof was suitable for solar panels. If it was "toast", if it was a rotted roof, then what solar company, in good faith, would put solar panels on it? The fact that our roof is old is irrelevant. It leaks in only one place, the place that started immediately after their installation. Again, I am not asking for a new roof. I am not asking for a new ceiling which is now water rotted and stained. I am merely asking for a repair of the hole in my roof made when they installed the panels.

      Sincerely,

      ********* ******

      Business Response

      Date: 04/19/2024

      Hello,
We would like to send a 3rd party roofer back out since the snow has melted to complete a more thorough assessment so we can determine how to proceed. ES Solar is completely willing to take responsibility for any faults on our end.
Based on the previous assessment it was determined not to be at the fault of solar, but it was not as thorough of an assessment due to the snow. If the customer is willing to let us proceed with this course of action, then we can determine how to work towards a resolution.

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me. I am very willing to have another roofer come out and look again and see if the source of the leak can be determined. Thank you!

ES Solar is a terrible company and we have not had any positive experiences with getting solar installed. We started the purchage process in 2022 but panels were not installed until 2023. We were told all about a fancy rebate through the government and that turned out to not be accurate. We were also told through the fancy iPad demo that we would pay less per month for our loan than for our electric bill. It's been just about a year and we still pay a couple hundred dollars a month for electricity. We had to wait months for installation to happen. Then when the installation done there were problems that had to be fixed multiple times. The only thing the company does is they say they come and run tests to make sure things are working. For all I know they aren't doing anything.

We were also told that the solar company handles all the necessary permits and they were familiar with our neighborhood HOA and would take care of all of that. We have since received violation notices from our HOA.

Lots of promises and hype to get the sale, and then nothing but headaches. Will never recommend this company to anyone. I dont believe we have enough panels to sustain our electricity usage and this is on the solar company to rectify at not cost to us.

Looking over other complaints its fair to say this isn't a single situation but happens with multiiple customers. I've also read that this company and others are way over charging customers for this product. I am assuming this company pays for their A+ rating I can't imagine anyone actually is happy with this company.

      Business Response

ES Solar is not responsible for getting approval from HOA's, that is stated multiple times during the process. One of the instances is is the approval of design of system, which was approved by Mrs. ****** on 10/25/2022. In that approval email it is BODLY stated that the customer is to bring the plan to submit to their HOA for approval. Attached is the email that shows design approval, with the statement on the customer submitting the plans to the HOA.

ES Solar did receive the permit for the job from South Jordan City.

Our Customer Service department did receive a voicemail from Mrs. ****** on 3/22, we have tried reaching out, but got the customers voicemail.

Customer Service Manager, Felisha, did talk to the customer about other grievances on 5/24/2023. Notes listed below on that phone call:

      -- [MAY-24-23 Felisha A*****] --------------
Called and spoke with customer and spouse - both spoke of issues how they felt the process was very slow moving, things seemed uncoordinated and very rushed/last minute. They also feel communication has been lacking.
They had some issues during the installation process and their main line for the network cable was cut (has since been fixed).
There has been a delay with getting their battery operational - it has not worked since installation - Luis is going out on Friday and customer was already informed.
I let the customer know that I would follow up with them on Monday to ensure that it was operational as it should be and also let them know that their solar has been operational so they have been producing in the meantime.
They had concerns about the system producing well and I let them know of the audit process, production guarantee and how it was based on the annual production, and how that works.
Customer currently placated and they have my extension if they would like to reach out on anything.

As for the government rebates, that is all dependent on each person and their financials. Our Sales Rep mention the rebate being "up to", to get a more accurate amount should be discussed with a tax consultant, as ES Solar are not tax consultants.

They misled and falsified information that made me believe that I wouldn't be spending as much as I am. They lied about the 30% tax rebate. They told me that I would get 30% of my system cost back at tax time and that it would change the amount of my loan to make my payment almost the same as what I was already paying in power. I filed my taxes and I didn't get a dime. My payment remains almost twice that much. Also they assured me that my system would bring down my power bill to a simple connection fee. My power bills are $100+ every month. It took them months to get the system working after install. They are very dishonest. They have terrible customer service.

We should that the customer signed up for the 12+3 flex loan which means this customer does not have a payment until April of 2024. As far as the tax incentive was thoroughly explained and ************************* (their Energy Technician) never promise that or no power bill. From **************** recollection, she even took some time to think about her decision and talk to an accountant about it so that is the homeowners responsibility and I always talking to a tax professional.

I am rejecting this response because:

Es solar did promise no power bill except the rocky ******** power connection fee. They said if my power bills were higher then that then they would cover them.  Why would someone in their right mind get a loan for solar if they still had to be responsible for the power bill, that doesn't make any sense.

In Regards to the tax incentive. He even showed me on his tablet what my payment would be after i got my tax return. Why would I get a loan for power if the loan payment was going to be twice as high as my existing power bill.  That doesn't make any sense.

Es solar needs to own up to their mistake and make it right.  I'm only asking for what I was told I would get and nothing more.  I'm currently talking to a lawyer if we can't get this resolved.

      Business Response

We do our best at ES Solar to build your system based on the bills you send into ** to cover your consumption needs so that you are having little to no additional power bills. However, ES Solar cannot and does not guarantee that you will never have any additional bills as your consumption needs may change over time.
This is why ES Solar guarantees that your solar system will produce what we promise within 8%, based on an annual basis - this is explained in your Production Guarantee paperwork that was given to you at the time of your Commissioning in May 2023 and again in November when **************** spoke to you about your concerns.

ES Solar is not a tax consultant company and we always recommend that you reach out to your tax accountant to confirm the details concerning the Federal Tax Incentive, as it is based on your personal tax liability.

**************** spoke to you back in November 2023 via email and explained your power bill (billing dates Sept. 14 - Oct 13 2024) and usage based on that bill. You received credits from your solar system production of $34.52 and a bill of new charges for $27.83 (minus the stormwater utility fee of $4).

      The following was relayed at that time;
"Overall your system is working amazing. Your production is outstanding, your consumption is low and you are receiving credits back from RMP.  As far as compensation, we will not be able to reimburse at this time. I do want to let you know once you hit your one year of your system turning on - which is May,18 2024, when I can run an audit on your system to make sure it is performing the way that it should be. Your production guarantee is based on a yearly not monthly production. I have attached your contract to this email. On page (4) it goes through the benefits of your production guarantee. "

At this time, your Solar is producing with no system alerts or errors and your battery is also operational without any issues.

Once you are eligible for your audit, you will need to reach out to ES via **************** to request it. At that time, ES Solar will put together the details of what your pre-solar usage/ consumption was prior to getting solar, how much your solar system produced over the last 12 months, how much you consumed in the last 12 months since getting solar and how that compares to your pre-solar usage. ES Solar will also take the time to review if your system had any issues over the last 12 months, among all other notations in your account. If your system does not produce within 8% of your Production Guarantee then ES Solar will reimburse you the difference which will be laid out in detail in your audit results.

Until then, ES Solar has delivered on everything we promised and your system is fully operational.

      Complaint: 21327219

I am rejecting this response because:

I know your company is not a tax consultant company and if that's the case then why is the salesman promising a 30% rebate at tax time that will cover 30% of the cost of solar.  My power bill before I got solar was between $150 and $225.  Why would I trade that for a loan payment of $372 for the next 25 years? It was because I was promised that before the promotional period was over on my loan then I would get 30% back at tax time that I could put towards my loan to take my payment down to close to what my power bill was originally.
As for the end of the year audit, I was told that, that would be something your company did automatically and I wouldn't have to worry about it.  He said that I would be completely taken care of and I wouldn't have to worry about any of that.  It's good to know that I'm the one responsible for making sure my system is working like they said it would. After paying out $76,000 it seems like there would be a little better service.
      Sincerely,

      ***********************

      Business Response

      Hello ******,

      Again, as previously stated and addressed;
      1. ES Solar cannot and does not guarantee that you will never have any additional bills as your consumption needs may change over time.
      2. All customers who purchased solar would qualify to apply for the 30% Federal Tax Incentive and ES Solar always recommends customers consulting with their tax accountant to determine their personal liability.

You have failed to mention any complaints concerning how the audit worked until just now. Again, your Production Guarantee paperwork was given to you at the time of your Commissioning and again when **************** assisted you in November. The paperwork explains in detail how your guarantee works and that you must request it.

Otherwise, ES Solar proactively reaches out to customers who have any system alerts to service the system free of charge to the customer per the **************** Warranty that ES Solar provides.

      Thank you

We made an appointment with our ES Solar salesman ************************* on or about March 20, 2023. He promised us ES Solar would build us a solar system that would meet all of our electricity consumption requirements. ES Solar required us to provide them a one year history of our electricity usage, so they could design us a solar system that would meet all of our electricity needs, and that we can expect to pay ******************** only the $10 minimum monthly connection fee. At the time, we explained that on the last ******************** bill that it included 3 months of much higher usage because we had installed a new 220 volt electric service for our hot tub, and to make sure that is factored in when our design is finalized. We were assured not to worry because they would take that into account when our ********************** system was designed and installed. It's our belief ES Solar undersized our solar system causing us to pay triple the monthly amount we were paying before we had the solar system. We are stressed as we bought the solar system to lower our liability for our monthly electricity power bill as we are nearing retirement. We ask, who in their right mind would agree to pay for a solar system that would cost them 3 times the amount for electricity than prior to the solar system being purchased, installed and activated. Since we've had the ES Solar solar system we have had to reduce the temperature for our hot tub to 80 degrees, not the normal 104 degrees to help lower our consumption costs which defeats the purpose of have the solar system to begin with. That was not what we were promised, and we trusted ES Solar to design us a solar system that would more than meet our electricity power needs. ES Solar CEO ********************* promises 100% customer satisfaction. We have reached out several times to ES Solar, and they have not returned our calls.

After speaking with *********************************** sales **** ************************** ********* and ****** have spoke on a number of occasions. ********************** is just simply not happy with his system and there is nothing we can do about it. We believe that he will find some relief this spring and start seeing much smaller power bills. That is the extent of the communication with our staff and **********************. As stated before, there isn't much that we can do at this point as winter time can be slow on the solar production due to the lack of sunshine.

      Complaint: 21245743

I am rejecting ES Solar's response because: There is no accountability from them regarding the insufficient solar system they designed and sold us. We believe that ES Solar doesn't stand behind their sales to consumers and commitment to 100 percent satisfaction. They are using a very easy response in an attempt to justify their huge mistake in designing our system and neglecting us of our hard earned money. Let me just say that ************************* claim of 100 percent satisfaction is not true (see *****************************************), and we keep getting told to wait for Spring. The fact is, ES Solar under sized our solar system and they know it. Our salesman ************************* is a very charming man, but he is a fly by night salesman tactics, and keeps making excuses regarding the solar system he sold us.

ES Solar did not properly analyze the data we provided them to design our system. What is Spring going to do to offset our monthly electricity costs, as they promised us? ES Solar is fully aware of ****** inclement weather, and is not providing us the amount of electricity credits with ******************** to offset our annual electricity bills.

I challenge *********************, to reach out to me and discuss this issue, and live up to his charter statement of ************************************* our case, he has done nothing and is not standing by his and his company ES Solar's 100 percent customer satisfaction promise.

      Sincerely,

      *****************************

*********************, CEO, jumped on a call today (2/27/2024) with ********************. In speaking with the customer, he agrees to wait until July 2024 when he hits 1 full year to initiate his audit with Customer Service. He understands that by waiting, ES Solar can complete a more thorough evaluation of his system production per the Production Guarantee and then determine their current consumption to know how many panels he needs to meet their increased demands.

      Complaint: 21245743

I am rejecting this response because: Our complaint is not resolved yet. There is still a conflict that relates to my initial complaint. We appreciate ************** taking the time to talk to us, but his responses did not satisfy the situation. We agreed to wait until July 2024 to reevaluate our system. Our requirements have not changed from the time the system was first designed. We trusted ES Solar to accommodate our power usage needs. In the call ************** indicated that once the audit is complete, and if we need additional panels to meet our needs, we will have to pay for the panels. That isn't satisfactory to us since we disclosed that the last two or 3 months of our one year history was to be our average usage. The system should have been designed to that specification. With all due respect, ************* keeps comparing us to his other customers. I had to explain that comparing us isn't relative to this complaint. In the meantime, we will wait until July to determine if ES Solar has stepped up and satisfied our complaint. At such time, we will reevaluate if ES Solar has done their best to make us 100% satisfied.

      Sincerely,

      *****************************

      Business Response

Trying to average the system and build it based on 2 months usage is not standard practice. That is why we request 12 months of usage to base their system off of and we still oversized it 116% based on all 12 months.

      Date: 03/01/2024

      Complaint: 21245743

I am rejecting this response because: That is an unacceptable response because we were buying a system and asked ES Solar to design a system that will accommodate the change in the last 2 months of our usage history.

in this complaint Im concerned that ES Solar keep evading the fact they didnt take into account what we asked for. If they arent accustomed to designing a system we requested. Its our opinion ES Solar and ********************* arent addressing the facts of this complaint. He continues to use other examples that arent relevant.  When is ES Solar going to address the facts of the complaint?

Again, we are willing to wait until July to have an audit of our system. Until such time, we are not going to accept comparisons to other situations that arent relevant to this complaint.

At the end of the day, its our opinion ES Solar is not going make this issue right. Its really up to them to respond with relevant remedies that will correct their error. We paid a considerable amount of money for this system that was well over retail and we put our trust into ES Solar to build us a system that meets our needs. Unfortunately, we are being given responses that arent meant to help resolve this complaint. Like I said, we are willing to wait until the audit is complete to readdress our complaint. Until then, we reserve a right to have this complaint resolved amicably to both parties.

      Sincerely,

      Business Response

      Hello *****,

The 2 months in question were taken into consideration, as stated, your system was oversized 116% to accommodate all 12 months (including the 2 showing increased consumption) and to try to oversize your system without over-sizing beyond your needs.

As ***** explained in the phone conversation, it is impossible for ES Solar to be able to foresee your next year's consumption based on only 2 months of increased consumption. Your system was sized based on the information you provided and we did our best to accommodate for changes and an increase of consumption.
In addition, to reiterate what ***** explained, until you have a complete 12 months of bills showing your increased consumption, since getting solar, we will not be able to determine how many more panels are needed to accommodate your increased power demand.

Until we are able to run an audit, ES Solar cannot determine if your system is producing what we promised it would per your Production Guarantee nor see how many panels are needed to meet your new consumption.

Commissioning  Notes (action) Sonnen no AC HU*
Called customer 05/11, ******** said he unplugged his system until he gets his papers from his lender. He is switching lenders because of intrest rate. Colby * has been in contact. *ut he doesnt want commission until paperwork is sent.

The customer had all sorts of frustrations about his system because of the issues he had with billing that delayed his process, he ended up getting a different loan then what he thought he was going to get and he is not thrilled. It also delayed him a ton. Overall though not a bad commission just not all that happy

At this point the customer will need to talk to their ********************** Technician to further go over what was agreed upon for Financing. I have passed this along to the Energy Technician, for him to reach out to the customer.

I have had solar panels for just over a month now. I just received my first bill since it was turned on. The installation and system seem good and the whole process was good. Until I recieved a power bill for just the same as before the installation of the solar panels. So on top of the payment for the solar panels I am continuing to receive a normal power bill. We did not get the battery but should be seeing a credit from Rocky ******** on our power bill. Credits are not there. I have called Es Solar with only information from them being that I dont have a battery so I'll still see a bill and the system seems to be working properly. Called Rocky ******** to find out why not seeing any credits and they respond is the system on? Of course it is on and Es Solar said everything is working. Turns out something is wrong where Rock ******** is not receiving any over production to credit. Well my meter and ap both say there is quite a bit of over production. Es Solar just says its because of power used at night, and rocky ******** said there is something wrong with equipment because they are not receiving anything. In the meantime I'm left with a power bill and a loan payment for something that's not working properly.

We bought solar panels from ES Solar. One of the big reasons we purchased from ES Solar when we did was because they offered $500 flat rate to remove and reinstall the solar panels when I got my roof redone. We told the sales rep ****** we didn't want to get solar panels because in the next 5 years we would be replacing our roof. He said that he would note our account that the only cost would be $500 to remove and reinstall the panels. We are now looking to get our roof done and I contacted ES Solar and they are claiming the cost would be $4500 and not $500. I have reached out multiple times to **** and have not received a response to my emails asking why my account wasn't noted like he said it would be. I want this resolved and response from **** on why he told me it would only cost $500. I would have went with a different company if I would have known I was being lied too. I am going to be sharing my story on social media if this isn't resolved. There was a lot of things that went on during this buying experience and the lack of knowledge of the sales man that I will let others know of also and to stay away from ES Solar.

We were told we were getting batteries and that was a lie and we were told we would be getting $16,000 dollars back in government rebates and our power bill hasn't changed a bit!
