From March 2023 to February 2024, Autoslide LLC used Evolved Commerce to manage Autoslide's Amazon US account. We paid $2500 per month plus a 3% sales commission for any sales made on Amazon. As part of this, they should have been crediting Autoslide LLC back for any returns made for refund. They did not do this from March 2023 to December 2023. We brought this up multiple times last year and they took no action. They acted liked they didn't know what they were doing. We terminated our contract with them in February of 2024. Now they claim that they don't have to refund the amount they earned in commissions. The practice is unethical and violates every standard of commission based sales. No where in the contract does it state that they do not have to refund back commissions for sales that were returned for refund. If this is the case, they could make fake purchases under random accounts and claim commissions with no recourse. Then return the purchases for refund. We want everyone to know not to do business with these deceptive people. A horrible company.

    Hello,

Attached is the agreement in question with some personal information removed for privacy of the customer. We entered into this agreement with the understanding that Evolved Commerce would be compensated a monthly retainer of $2500 + 3% os sales. There is no mention of a return allowance or any indication that we would be refunding any commissions earned from items sold and then returned by customers. The idea that Evolved Commerce would buy the items and intentionally inflate the revenue number just to turn around and return them and keep the commission is a clear misunderstanding of how Amazon works and how our billing structure is set up. Not to mention it is very easy to show this is not true, you simply can look at the order reports and see that no one from our organization purchased the product. To further show that this claim is false, our commissions are only earned on total revenue achieved each month, which would account for any returns. As an example, if $10,000 was sold during a month but $2,000 of that was later returned, it would count as a negative towards the month in which it was returned. This would require Evolved Commerce to make up the negative balance + any new sales in order to achieve a commission. Therefore any claim that we took commissions not owed to us is not accurate.

We are happy to provide the statements from Amazon as proof of this logic, we would just need access to the Amazon Seller Central account in question.
