      We have reviewed your complaint filed with the BBB. We noted that you seemed to be frustrated about rules not being enforced and clean-up not being done to your satisfaction. We take homeowners concerns very seriously. However, your complaint is misdirected. Mountainwest Property Management does not make decisions for ********************* about enforcement of the rules and clean up. We simply carry out the directions we receive from the ***** of ********** The ***** is our legal client and the party we have entered into a contract with. We have an obligation to do what they say. The ***** is pleased with our work. We have followed up on all complaints about violations and clean up.

      Along these lines, the BBB shouldn't even be taking these sorts of complaints.  Homeowners are not our customers, even though the BBB inaccurately describes them as such.  The ***** is our client and they are not complaining about our performance.

      It is important to not only recognize the the ***** makes the decision regarding enforcement and maintenance, but that, pursuant to **** Code ***. 57-8a-2, the ***** has discretion in making those decisions. They can reasonably choose if and to what extent rules are enforced and the level of maintenance. You may not agree with their decisions, but that is a complaint you need to raise with the *****. For what it is worth we have managed ********************* for many years and have found that they are doing their best to act in the best interests of the association as they try to consider not only enforcement and maintenance, but costs and ******* in the community.

      Regarding your last point, that we have mismanaged fees/funds, please explain how we have mismanaged fees/funds  This is a serious accusation. It appears that you are accusing us of a crime.  In **** defamatory statements that involve crime constitute libel per se, which means that if you cannot legally support your accusation, Mountainwest Property Management could *** you for punitive damages.
