I signed a contract with Chase B****, Your Friends LLC on September 13, 2022, to build an enclosure around my swim spa in the amount of $15,759.82, and on October 25, he changed the contracted price to $16,731.92 which I agreed to but reminded him we had a contract for a set cost, and I would not pay any more. The project was to be completed in a week but has never been completed. Chase kept coming back to me asking for more money and changing the contracted supplies which compromised the project claiming they were too costly. He promised to finish the project first thing in the spring but begged me to pay the remainder of the invoice so he could pay his men. I told him I didn't want to. We argued because he felt the labor cost was under quoted at $11,500. He promised I could trust him and would put me on his schedule for first job in the spring.

His work inside the enclosure didn't hold up over the winter as moisture got into the walls and doorframe, which prevented the door from functioning. The door frame took on water preventing the door to open in the winter or close in the spring. The sheetrock and tape inside the enclosure separated at the joints and water pocketed in the walls (Latex paint rather than moisture repellant paint was used.). Chase came back in the spring after I called and texted. He came out and took inventory as to what needed to be completed and fixed but said he couldn't get to it until August 2023 because his band was touring until August. He admitted that the damage was done because they rushed the job before winter. I have tried to no avail to speak with him to complete this contract. As of this date, August 29, 2023, he has not returned my calls or text messages and has not come back to complete the contract which he admitted to me had not been completed.

    Business Response

The amounts referred to by ******* were the estimated amount. We clearly stated that the design had not been decided yet and that this was the initial estimate. We were still trying to figure out how many skylights, doors, windows etc. when the contract was signed and it was clear that the estimate would adjust accordingly and ******* acknowledged that. I did try my best to keep things as close to the estimate as possible, and I informed her when we had reached her limit and she pushed for us to continue and finish the project.

The drywalling was added into the finishing of the project later on. I explained that with the temperatures being below freezing, that the mud would not cure properly and that it may cause issues. I would not have moved forward with this process until the weather and temperatures were better, if the decision was up to me. The area that is receiving water is from a section of the wall that sits about 6 inches from the spa and we are unable to attach the bottom of the drywall. This concern was brought up in the designing process. The wall sits between the fence and pool and there is no way of making it more accessible and will take extra labor to be able to create a way to seal that area.

The paint that was used was provided by ******* to keep cost down.

The current cost of materials and labor is at around $20k and that was with significate discounts and free labor due to battling the elements. ******* refuses to pay a cent over the estimate. So I will not be moving forward.

    Complaint: ********

I am rejecting this response because:  Most of what Chase states is a bunch of lies.  When I contracted with Chase, I had a tent enclosure around the spa, which I gave to him for free.  When discussing the cost to build the enclosure, I told Chase that I needed to refinance my house for the cost of the build and asked him to be as close as possible to what the cost would be.  When he provided me the estimate, he assured me verbally that they could stay close to that price, he even stated that it might be a little more or maybe even less than what he quoted.  I the contract with what was discussed, unfortunately he did not put the cost on the contract.  When I asked for the contracted price in writing, he gave me another estimate and I didn't notice until last week that it also was an estimate.

I am a single, retired woman and there is NO WAY I would have given him a blank check for the build.  Since last week, I have gotten verbal estimates from two other contractors and both told me that "whoever did the work on this enclosure, didn't know what they were doing".  The sky lights are leaking which is why the water puddled in the wall and the door frame was installed incorrectly and is warped.  Also, the paint I supplied Chase was for the exterior trim and it was exterior paint.  Chase supplied latex paint for the dry wall and was the thinnest paint job I've ever seen, there are places on the walls that they even missed.  The only time Chase mentioned the mud was this spring when he came back to take inventory. Again, I state that he told me it would take week to build but it took October and November and still wasn't completed.  If his workers would have shown up every day and put in a full day's work, it could have been done.  Instead, they would show up around 11 AM (somedays not until 3) and leave at 3 or 4 and only one or two men would show up most days. Chase didn't show up every day. My neighbors all complained because while they were here, they were playing their music so loud it rattled their walls.  I had told them I was told it would only be a week they would have to endure it.  Obviously, that didn't happen.  I'm finished arguing with Chase about what he thinks he said and what I heard him say.

I finally received a text message from Chase last week after I messaged him that I filed with BBB, After that message, I knew he was not going to make good on the contract, so I talked to two other companies and when they inspected the project, they told me that the company who did my build obviously didn't know what they were doing, and that Chase's labor costs were high.

At this point, I wouldn't have "Your Friends" back on my property ever again, they provided very incompetent work and weren't willing to fix the problems they caused.  If anyone asks who did my build, I will definitely warn them against them.

    Sincerely,

    ******* ****

Chase states he will not be moving forward even though he knows the agreement we had and changed the verbal agreement we had made.  His work is falling apart.  At this point, I believe the public should be aware of the tactics he uses; Estimate vs. Contract prices.  He is hiding behind the estimate and is not willing to fix the issues he created by not doing the job correctly.  He does shoddy work.  And now he wants more money to fix this.  This is outrageous.
