    I moved out of a rental in August of 2023. In September of 2023 I received a text message from the landlord requesting $4902.00 in move-out fees. I responded and told them that I would pay for approx $480 of the cleaning and repairs, including my deposit. But that the rest of the items they listed were either wear and tear or in that condition when I moved in. In Nov. 2023 I received a collections notice from ReCheck in the amount of $4959.75. I have requested in writing 3 times proof of the reported damages, replacement cost & verification they were completed to that unit . They keep sending me the same "proof" in response. That includes typed up word documents with contradicting information. The photos that they sent I can't verify came from our unit.

    We moved into this property in Feb 2019 & while we lived at this residence it was sold twice. The current owner was also in the process of selling this property and others while I lived there. They were in the process of updating all of the the vacant properties.

    I don't know what else to do to resolve this matter, so I am reaching out to you. I have the images that they sent but I couldn't get the file small enough to upload.

    I am attaching the communication that I have received from them & my responses.

    The tenant tied to this dispute vacated the premises 08/31/2023, and after thoroughly inspecting the apartment, damages to the property were extreme and it was left in filthy, uninhabitable conditions. 
    After managing properties for over a decade, we have never had a dispute nor had an apartment left in such a disastrous state. The premises had to be entirely overhauled, gutted, & remodeled. The tenant left their personal belongings, trash, & food in the premises which had to be hauled off and the carpet and flooring was damaged which required replacement and the walls were repainted due to the excessive holes and marks thereon.

    Per the lease agreement, the tenant is responsible for the repairs needed in addition to the cost tied to removing their personal belongings left on the premises. We provided a Final Account Statement in addition to an itemized list of damages which included the costs tied to repair and clean the space; it being provided by an independent contractor. All the images of the premises at the time the tenant vacated the premises can be provided upon request and verification of the itemized list of damages and costs tied to repair the unit can be verified by contacting the independent contractor. The Residential Lease Agreement, Final Statement of Accounts and the Itemized List of Damages have been attached to this dispute for verification.

    I am rejecting this response because as I previously stated there has been given no proof of what the repair costs were.  It isn't my responsibility to contact the independent contractor.  Also as I said in the initial complaint multiple units were being remodeled to sale, I have no proof these cost were related to my unit.  Most of the items listed are normal wear and tear from living in the unit for several years.  I am willing to settle on the following items because they don't fall under the items that are 1.  Normal wear and tear or 2. Items that you were going to upgrade for the sale of the unit.

    Cleaning Fee - $650

    Patch Holes, etc - $300

    Minus Deductible - -$500

    The Itemized list of repairs is proof of the costs tied to repair the space. Anyone with interest regarding this dispute can contact the independent contractor for verification and view all the images of the premises at the time the tenant vacated the property. It was required to clean the ceilings, fan, walls, baseboards, window seals, fridge, stove, kitchen sink, countertops, all the vents, bathtub, bathroom sink, toilet, floors, hood vents and kitchen cabinets. The carpet and flooring was damaged which required replacement and the walls were repainted due to the excessive holes and marks thereon. Five of the blinds including the patio blind, bathroom faucet, as well as the garage door were damaged and the closet door in the bedroom as well as the bypass door in the bedroom were missing. The tenant left their personal belongings on the premises that had to be removed and the bathtub had to be resurfaced. The damages caused DO NOT constitute normal wear and tear.

    It appears that we are at a stalemate on this issue.  I offered a settlement in the previous response.  I don't really know what we can do on our part to come to a resolution.
