    On 9/13/2022, Cloud 9 Builders signed a Wind River Timber Company (owed by Bryce W*******) purchase order to purchase exterior trim and siding for our Tappen residential construction project (main house and barn) and paid the requested a deposit amount of $55,609.41 via check (50% of the entire order). Bryce promised to deliver all of the trim and siding by November 30, 2022. In January 2023, $25,094 worth of product was delivered (trim and siding for the barn, some of the fascia for the house, color was incorrect).

    Since then, Bryce has seldom answered our calls or texts and has given excuses for why the material is delayed, and empty promises about the delivery of the rest of the order. In March 2023, Bryce stopped returning calls completely. On March 15, 2023, Cloud 9 sent a demand letter through our lawyer via email to Bryce. He didn't respond. On March 18, 2023, Cloud 9 sent certified letters to Bryce at his business address in Ogden, UT and to his P.O. Box in Hooper, UT. Both letters were returned to us unopened. On April 14, 2023, I got in contact with Bryce via phone by pretending to be a potential new client. I provided our bank info to him and we agreed on a deadline of April 21, 2023 for him to initiate a EFT transfer of $30,515 back to Cloud 9. We did not hear from him at all as of 11pm on April 21, 2023 so I sent him a text asking about the refund. He texted back immediately with a bunch of excuses about why the money hadn't been sent via EFT yet. He said he would follow up with me on April 24, 2023. It is now April 27, 2023 and I haven't heard another thing from Bryce W*******. I had warned him when we spoke on April 14, 2023 that if we did not see the refund, I would be submitting fraud claims and would leave negative business reviews wherever I could. That is what I am resorting to now.
