On or about August 2023 Stauffers Towing located at **** ** *** *. Orem Utah towed and stored my Mercedes C-Class VIN ***************** from the Orem Police Department..........

I was in the Hospital and otherwise disposed but myself and two other family members attempted to find my vehicle including calls to DMV of which had no location information for my vehicle..........

Vehicle was not entered into the national reporting system database..........

Title and driver's license with an address was in vehicle..........

On October 4th an Officer was able to find my vehicle and upon a visit to the above location..........

The officer was told they had the right to sell my vehicle to themselves and take ownership. The officer provided documentation disputing their claim. The vehicle is currently located at Stauffers Towing **** * ******* **** West Haven, Utah 84401..........

According to the State they are allowed to apply for title upon filing appropriate documentation with DMV showing a "reasonable effort" was made to contact the owner after 45 days and apply for a title..........

Stauffers Towing was asked to provide documentation showing certified letters, filing to DMV etc via fax to Orem Police Department. They disclosed they had none and would not fax..........

      Business Response

Thank you for the opportunity to response to this customer.  August 2, this vehicles was picked up at the request of Orem City Police Department.  The city had placed a State Tax on this vehicle for being abandoned and unregistered.  In the State of Utah we are required to post vehicles on IVS.  I have attached the impound form and the document with confirmation number showing the call was uploaded to the State's notification website.  The State of Utah is then responsible for sending owner and lien-holder letters.  The State typically sends these notices to the titled owners and lien holders listed with the States.  The license plate shows the state of VA so I can only assume the letters went to that state.  The State of Utah holds these vehicles in their state approved yards.  Stauffer's is a state approved yard and held this vehicle for them for 60 days when the State issued a certificate of sale of the vehicle in-lieu of towing and storage.  This vehicle was legally towed and storage at the request of Orem City Police officer and the State of Utah.  If Denene would like to call and talk she is welcome to call and talk to us again about her vehicle and we can again explain the process of how this vehicle was attained and then later sold.  If Orem City Police followed up with Ms. Wrights claim, they too would find that everything was done exactly as it should be.

Our 18 year-old son got in his first car accident, and the police officer called this towing company. Their guy came out and told my husband when he asked about cost that since we had Bear River insurance, the tow would be "covered." My husband was comforting our son, so he let the guy take the car. My husband has a truck and we could have towed the car home ourselves (which was about 5 minutes away), but he let Stauffer's take it 16 miles away because their guy said Bear River would pay for it. The next day, my husband called Stauffer's and they said we owed $340 if we wanted to pick up the car. It hadn't even been 24 hours, but apparently they charge an extra $40 "per day," which starts at midnight. When my husband called and told them what he'd been told about our insurance paying for it, they said they would take off the $40, but that's it. When we got there and asked again about honoring what we were told, they told us to call Tory, who is the manager. We did that, and Tory had us wait 25 minutes while our kids were waiting for us to pick them up, just so he could call us back and say that his guy didn't say that, and he wasn't willing to discount anything more. I asked him if he could help us out even a little considering we only allowed the tow because we were misinformed by his employee, at which point he asked me what we were going to do with the car. I told him we were going to take it home and the line was silent. I then realized he had asked what ARE you going to do, so I told him we were selling it to a junkyard. He immediately said, "Nope, no discount." I told him I was surprised the company had so many positive reviews, and I was going to share our experience. He said, "Fine, go ahead." Not only did he accuse my husband and me of lying, he was very impolite and dismissive. We paid and took the car, and later realized we'd used a credit card that had to be paid off that month to avoid interest. We asked Stauffer's to charge another card. They said no.
