SECTION 5: RESCISSION; CANCELLATION POLICIES; FREEZE; REFUNDS
RESCISSION. YOU, THE CONSUMER, MAY RESCIND (CANCEL) THIS CONTRACT AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS
DAY AFTER THE DATE ON WHICH THE CONTRACT IS EXECUTED.
CANCELLATION RIGHTS.
After expiration of the 3-day rescission period, you may cancel this Agreement only if you qualify as follows:
(a) Thryve ceases to operate.
If THRYVE ceases operation and cannot offer you services at an alternate THRYVE facility located within five (5)
miles from your original location, you may cancel this Agreement without penalty and receive a pro rata refund, where applicable, for any prepaid
sums.
(b) Thryve relocates.
If the THRYVE facility where you originally had a membership relocates more than five (5) miles from its original location,
then you may cancel this Agreement without penalty and receive a pro rata refund, where applicable, for any prepaid sums.
(c) You die or become totally disabled.
If you die or become totally disabled, then you or your estate may cancel this Agreement without penalty
and receive a pro rata refund, where applicable, for any prepaid sums.
THRYVE may require that your disability be confirmed by an examination of
a physician agreeable to you and THRYVE.
(d) You relocate from your permanent residence.
If you move your permanent residence to a location more than 25 miles from the THRYVE
facility, or an affiliated health studio offering the same or similar services and facilities at no additional expense to you, then you may cancel this
Agreement without penalty and receive a pro rata refund, where applicable, for any prepaid sums.
You must provide THRYVE with proof of
relocation such as an updated lease or mortgage agreement, a state-issued ID, a major utility bill, or military service orders.
TERMINATION OF RECURRING DUES MEMBERSHIP.
If you are a M2M member, you may terminate this Agreement at any time by providing THRYVE
with a 30-day advance written notice; provided, however, that if you terminate your M2M membership prior to your fifth draft payment, you will be
charged a cancellation fee of $35.
If you are a Term member, unless you rescind or cancel your membership as stated in this Agreement, then your
membership cannot be cancelled until the expiration of your fixed initial term.
To avoid rolling over into Evergreen Status, you must provide THRYVE
with written notice of your intention to cancel at least 30 days in advance of the expiration of the initial term.
If your membership automatically
renews, you may cancel at any time without penalty by providing THRYVE with a 30-day advance written notice.
Whether you are a M2M or Term
member, once THRYVE receives your written notice of cancellation, your membership will remain active until the expiration of your then-current
billing cycle.
FREEZE POLICY. (a) MEDICAL.
If you are unable to use the facility due to a medical disability, you may request a freeze of your membership in
monthly increments for a minimum of one (1) month and a maximum of six (6) months per year.
You must provide a doctor’s note at the time of
requesting a freeze.
THRYVE reserves the right to verify the note with a doctor and you agree to waive any doctor/patient privilege and execute
any release required by such doctor solely with regards to the medical reason stated in the doctor’s note for the medical freeze.
(b) NON-
MEDICAL.
If you desire to freeze your membership for a non-medical reason, you should consult with your facility.
THRYVE reserves the right to
adjust this freeze policy from time to time at its sole discretion.
All requests must be received at least 14 days prior to your next billing date period.
Retroactive freezes will not be accepted.
THRYVE reserves the right to charge a freeze fee for any membership freeze.
REFUNDS.
Refunds, if applicable, shall be made at 30 days after receipt of notice of cancellation.
NOTICE.
All notices under this Agreement must be delivered electronically to [email protected], or by certified mail, to
Thryve Fitness - West Jordan 7046 South Redwood Road, STE C, West Jordan, UT 84084.
WRITTEN REQUESTS.
Memberships cannot be cancelled by phone, email or verbal conversation.
Cancellation requests will only be honored if sent
in writing.
Cancellation is effective on the date notice and proof is received by the club
