    I am filing this complaint along with my wife **** ****** against Variety Mobile Homes in Abingdon, VA. We had decided to sell our home in ******* and move to Virginia in June of 2024. As we were unfamiliar with Virginia we relied on a referral by the **** ****** ****** to apply with Variety Mobile Homes to place a manufactured home on the land we had committed to purchasing.

    From our first contact with Variety Mobile Homes (salesman **** and Administrative Assistant *******) there have been multiple problems such as failure to provide important information in a timely manner causing a delay in the completion of this contract including, but not limited to, false information of floor plan of the unit purchased, a failure to provide proper inspection information, lack of transparency regarding the contract and failure to work with the real estate broker involved with the land we purchased.  In fact it was our real estate broker who pointed out that Variety Mobile Homes did not seem to know what they were doing.  

    In late September 2024 Variety Mobile Homes took a deposit of $1,000 to hold a single wide manufactured home for us and on October 4, 2024 a certified check for $35,000 down payment was sent, intended for escrow company *********** *****, this money now seems to be missing.  Because the owner of Variety Mobile Homes, Jerry Farmer, has refused to even speak with us regarding this matter, and due to his threatening and insulting manner we are now demanding this contract be terminated and a full refund be made.

    Please be advised we have refunded Mr. ********’ and Ms.
    ******’s deposit of $36,000. See attached check stub and credit card receipt. I apologize for any misunderstandings between our sales team
    and Mr. ********. I feel the long-distance communication was just misconstrued on
    both behalf. I made every attempt to resolve this issue, see attached
    emails sent to and from Ms. ******. However, Mr. ******** and Ms. ****** decided to pursue their home purchase elsewhere. Therefore, a full refund was
    made on October 22nd, 2024, with them both personally coming to our
    office and picking up their refund check and credit card refund receipt.It is my opinion this dispute has been resolved. With any further questions or concerns please feel free to

    THE DATE THAT WE BAUGHT AND SIGNED THE PAPERWORK WAS 08/22/2022 GAVE A TOTAL OF 30,000 DOLLARS DOWN . DELIVER WAS LIKE PROMISED . THE PROBLEM WE HAVE IS AFTER THE SET UP WAS DONE. REPORTED FLOORING ISSUES CAME ON 10/24 AFTER NUMEROUS PHONE CALLS AND TEXT THEY CAME AND ACTUALLY CUT THE FLOORING PUT GLUE ON IT AND ACTUALLY MADE IT LOOK WORSE THAN IT WAS AND SAID THAT THE REPAIRS WERE DONE. ALSO THERE WERE PLUMBING HOLES IN THE HOME WHICH I WAS TOLD THAT IS VERY COMMON FOR A NEW HOME !. THE GUY THAT DID THE WORK WORKED FOR THE DEALERSHIP THAT SOLD US THE HOME. I GUESS HE DID WHAT HE WAS TOLD TO DO AND HAD A PAPER THAT HE WAS HERE AND REPAIR WAS DONE . HAVE VIDEO IF NEED TO SEE THE WORK AND YOU CAN SEE THAT IT IS WORSE THAN BEFORE .ON THE PAPER THAT I HAD TO SIGN THERE WAS NO WERE ON THE PAPERWORK THAT ASKED IF I WAS SATISFIED WITH WHAT WAS DONE . tHIS IS A BRAND NEW HOME AND NOW HAS PATCHES IN MY NEW FLOOR UNACCEPTABLE..

    apologizes for the late response, I was out of town last week. Since my return
    I spoke to the Sales Manager which has informed me he has been in contact
    with Mr. ******* ***** on several different occasions and attempted to help Mr.
    ***** with repairing the floor to the best of our ability.Upon
    selling new manufactured homes the warranty lies with the manufacturer in which
    the customer is made aware of during the closing. The Sales Manager has contacted
    the manufacturer with Mr. *****’ concerns and issues. We are willing to help in
    any way possible, but this repair is the responsibility of the manufacturer
    not the dealer. Please let me know if we can be of any further assistance. Sincerely, ***** ******* President

    The manufacturer said they would find someone to do the necessary repairs because we don’t currently have anyone qualified to do them. We made Mr. ***** aware they are looking for someone to fix his flooring. It’s my understanding Mr. ***** has also been in contact with the manufacturer.
