      I want agreement and acknowledgment from Samson Properties (*********************** and *************************) to terminate my listing agreement for my home. I have requested a termination of the Listing Agreement based on what I feel is an ethical violation in real estate that being that *********************** of Sansom Properties did not act in the best interest of me, *************************************, her client. I have requested on two separate occasions (26 May (email) and 22 June (certified letter) of 2023) to terminate the contract between myself and *********************** representing Samson Properties to come to a mutual agreement to terminate the contractual obligations of the Listing Agreement that I entered into with said company. *********************** (Realtor)/************************* (Broker) of Samson Properties are nonresponsive to my requests to terminate the Listing Agreement. On 19 June 2023, after the buyer could not secure a long for the purchase of my house, I was informed that I was entitled to the ******* money the buyer offered. I only received half of the $10K earnest money. *********************** demanded half of the $5K I received. I offered her $1500. *********************** countered my offer for $2000. At that point, I informed my attorney, *******************, to convey to *********************** that I would wait the 30 days (as of 26 May or 19 June) and pay the $695 as required by the termination clause of the listing agreement. I also stated that I am willing to pay any additional fees I am legally required to pay. I feel like **************** of Samson Properties are holding my house for ransom until I agree to pay additional costs outside of the listing agreement termination clause. The termination clause states that I am subject to a $695.00 early termination fee. **************** informed my attorney, **************************, that she would terminate the listing agreement with if I paid a 5% sales fee of my house, a $345 settlement fee and a $895.00 administrative fee as my house was not sold, exchanged, or transferred to another owner.

      At the time of the termination request, it was acknowledged and the home was withdrawn from the market.  The agreement was terminated per the Terms of Termination in paragraph 4 of the Exclusive Right to Sell Residential Listing Agreement.  This has also been communicated to your attorney and as I understand, this has been resolved.  We wish you best of luck in the future.

      We are first time homebuyers and purchased in January, this entire transaction has been a nightmare. We worked with ************************* and *********************** as they were the sellers agent and broker. They have been far from professional. ***** had been ignoring our agent, lying to our agent, and ignoring us. After our offer got accepted we had a repair contract and the seller had signed, she then told our agent the repairs were finished. Our agent asked so many times for receipts from licensed contractors and ***** kept saying she'll send them to her and the house was good to go. On good faith we believed her that she would send the receipts and closed on the house and she never did, because she never had them because the seller never did anything. She had initially lied to our agent before we even closed saying there was and hvac unit installed and she physically came to the house and saw it, but we have inspection photos, the hvac unit was not there. She decided to argue with our realtor and swear that it was there, but it wasn't as again we had photos. When we moved in we found out there is a major disclosure issue, as the hole in the front of the home that needed to be repaired was where they dug up the sewer and there was a broken main line. The fact we have photos from the inspection showing this hole shows clearly and confirmed by a contractor that the seller knew about this and didn't disclose it. ***** has sworn she cannot contact this seller because he's in *****. Everytime our realtor has asked her for the contractor information that have done work on this house, ***** ignores her or does not respond. ************************* then emails asking us to stop contacting *****, and that wed need to mediate. She claimed ***** was professional throughout this entire transaction. Ignoring requests for receipts, not doing due diligence, being negligent, and lying to the buyers/not disclosing this is far from professional.

      To Better Business Bureau; 
      I am responding in reference to the complaint ID ********. I apologize for the delay and want to provide the following in regards to the complaint. 
      The complainant went under contract to purchase the subject home and was afforded the opportunity for a home inspection. As a result of the inspection, the buyers and sellers negotiated repairs to be made prior to settlement. The listing agent also relied on information from the Seller regarding the presence of the HVAC system and its location in the attic. As the Listing Agent did not have access to the attic, when it was discovered at the inspection that it was not present, it was communicated to the Seller and rectified immediately by installing an HVAC system. The listing agent followed up with the seller for the repair receipt before the settlement. The Seller also informed the Listing Agent that the other repairs had been made and provided receipts, of which were delivered to the buyer. Upon pre-settlement walk through, it was noted that there were still outstanding repairs. While the Listing Agent made numerous attempts to have Seller complete the repairs prior and after settlement, the Buyers opted to move forward with settlement. To the best of her knowledge, every inquiry and email that was sent by the complainant was responded to and followed up by the listing agent. Any/all receipts that the Listing Agent obtained were delivered and contact information for the contractor was sent at the buyer's request and initiated an email between the seller and the buyers to resolve the issues. Per the contract, the Buyers and Sellers agreed to mediate any disputes that arose from the terms of the contract. Since this issue is between the Buyers and the Sellers, the next step is to initiate mediation. The contact information for the Seller was sent to the Buyer's agent, and it was indicated to the Listing Broker that the complainant would be pursuing mediation. As the Broker representing the Seller in this transaction, we understand that the buyer is not satisfied with some of the repairs made, however, they did choose to settle and per the contract, should pursue mediation with the other party as agreed.

      Good evening, My name is *******************************. I purchased a house on 4-15-2022 My realtor and the salers agent both worked for Samson properties! There was some work that needed to be done to the house regarding mold prior to closing! There was a contingency in place and I was told that all work was completed, however my whole entire home is now molded and I been made aware by contractors that none of the work that was agreed to in the contingency was done, I have tried reaching out to the salers agent and have gotten no response. Also I have in writing my realtor stating that the work was not completed as agreed. Due to this my children and I have been displaced as the house has been deemed unlivable. Also my son who is a severe asthmatic has suffered numerous asthma attacks, hospital visits and hospital stays since moving into the home. For these reasons and more I will like to file a formal complaint against Samson properties and they agents. I am available anytime of the day to discuss this matter in more detail.

      As the Broker for Samson Properties, I am writing to respond to the subject complaint.  I apologize for any tardiness, as this took a while to reach my desk.  I did have a chance to review the complainants' concern earlier in this year.  At that time, I reviewed the documents, and provided the following response to the complainant on 9/16/2022.  I understand that they have a concern with regards to the terms of the contract, however, it is between the parties to the contract.  As the parties had signed a Maryland Realtors, contract, this provides that they proceed to mediation as the next step, which I am not sure has happened yet.  With all due respect, this should be the next step in resolving the issue.  Please see below response originally provided:

      Good afternoon, ******,
      Thank you for providing the attachments and information.  I have had a chance to review the contract and associated documents.  It looks to me like the contract was an as-is contract with the right to terminate, but the seller did offer to 'remediate areas with bacterial growth.'  From the receipts and inspection reports provided, it looks like they did perform to what they contractually agreed to.  With that being said, if you feel otherwise, as I am a Dual Agent in this transaction and must remain neutral, the next step would be to initiate mediation per the Maryland Realtors Residential Contract of Sale.  I will be sending this information to your agent in the event you wish to pursue this route.  You certainly may consult with counsel as well.  If you have any questions about the process, I'm happy to help with that.  The mediators are well versed in the Maryland Realtors contract and forms.
