    MDM Septic Services was hired to pump the septic tank. We had used the service before and in the past, the company would park the truck on the street and bring the hose up the driveway to the back of the house. This time, the driver insisted that he could not reach the tank that way. He said he needed to back the truck into the driveway. He said he was worried the driveway was narrow and the truck was heavy. He said he could get a **ghter truck and I told him that would be ok. Instead, he proceeded to back the truck he had with him into the driveway. In doing so, he damaged the corner of the driveway, cracking it in two places. The owner of the company said that since we had "allowed" his driver to access the driveway, he was not responsible for the damage done to the driveway.

    Mrs ** told us to back on the driveway and done so with her permission.  Its dangerous to work from the road so the employees told her to use the driveway.  We also found out that the driveway was never legally permitted driveway and thus was poured 2 1/2 inches thick instead of the required city code of 7".  I made her an offer and she refused and also gave her a price for a concrete company to repair the damage and she refused.  We now have a court date scheduled to resolve this issue.  We made a resonable offer to fix the damage but she wants the whole driveway fixed.
