    I paid over *** for New look Home Improvement to install a new fence in August 2022. The fence, in my opinion, was never installed properly. It goes up and down, not what was in the contract. In the Contact under “New Fence Information” the “Straight on Top“ Box is checked. The fence was not installed that way. By April of 2023 two of the posts were visibly leaning. “see Photos” I called the company, and the owner he came out on 18 April 2023, but said that it was caused by rain water seeping into the ground and even if he fixed it it would happen again, he said he wasn't going to do anything. The New Look Home Improvement Contract that we Both signed stated under “New Look Terms & Conditions” Paragraph 14. Warranties: One year from date of installation. Very dissatisfied with contractor performance.

    Any fence is subject to the ground where it is installed. If the ground is not level, the fence will not be level unless it is raised significantly off the ground in which case, it has more probability of blowing over as the posts only go 30" into the ground for an installation even with the ground. 

    In this case, Mr. ********** had an issue that two of his posts and sunken into the ground 8 months after installation. As I inspected the posts, my foot sank into the ground nearly covering my foot. I pointed this out to Mr. ********** that the ground is unstable in the area of these posts. Not coincidentally, this ground is in the area around trees and what look like a former flower bed. 

    There is at least a bag of concrete in every post hole and the fence was installed correctly. After 8 months of rain and any other contributing weather factors, this ground is soft enough for my entire foot to sink into the ground just by walking on it. How does he expect the posts to stay stable in this environment. The only solution would be for a landscape company to come in and level the ground completely and make it stable and then reinstall the posts. We are not a landscaping company. I do not know how to do that. We install fences. We installed this fence according to code. This is not a defect of the fence nor the installation of that fence.

    I am rejecting this response because:

    Mr. **** was not at the job site during any of the installation process. I am not sure if cement was used on all of the post that were installed, as I was not watching the installation crew the whole time. I do believe that the failure of the two fence post after only 8 months, indicated a substandard installation technique that are used by this company.


    Mr. **** statement in “Message from Business” “As I inspected the posts, my foot sank into the ground nearly covering my foot “ is patently false, while he was on my property 18 April 2023 at no time did he approach, touch, or put his foot in the ground by either of the two post in question.


    Proper installation techniques were not followed on this job, hence failures follow. I would not be surprised if more post failure will follow in the coming months.


    All I am looking to achieve is the for the company to honor there warranty and fix these two posts, that were improperly installed.
