In January 2022, we signed a contract with ****************** to complete an addition on our home that included a dining room, mud room, and new deck. As per the contract, the estimated completion was **** weeks. Work began in February 2022. There was a delay, by no fault of ******************, due to ************** moving power lines. Those lines were moved by ************** on June 10, 2022. Since June 2022, we have been repeatedly lied to and mislead by ****************** as to his ability to finish the job in a timely manner. To date, he has received $78,000 from us (receipts attached) and still has several aspects of the contracted work to be completed. Additionally, there is work that has been completed that needs to be corrected. Beginning in September 2022, ****************** would often misrepresent a timeline for which the job would be finished, only for those deadlines to never be met. Statements below are proof of this misrepresentation. Full text of messages has been retained. 9/21/22: "Week of 10/17 - Siding, Finishing Deck and Finish"10/16/22: "Week of 10/31 - Siding, Finishing Deck and Finish"10/24/22: "Week of 11/14 - Siding, Finishing Deck and Finish"1/29/23: "I hope to be substantially completed in 6 weeks/possibly 8 weeks." 3/27/23: "Finishing things/the rest by the end of April. I foresee being pretty well squared away late the week of 4/17, but to be 100% I have confidence with the end of April."4/12/23: "I am still confident with the end of April."4/18/23: "It will be a busy week Tuesday-Friday next week (April 25-28). The following week (week of 5/1) we will take care of inspections, punch list, and the deck." On 6/24/23, he texted us, saying he does not have the money to complete our job and hopes to have it by July 17, but does not have a specific timeline. There are several items that ****************** was contracted to complete but still has not completed, nearly 18 months after our contract was signed. Attached is a complaint we filed with DPOR.
