    American Water [Grantee] per Deed Book 835, was asked to fulfill their obligations of assisting other Grantees in maintaining a 500 easement road from ************** to a well pump and well head located at the bottom of ******************************************************. However, American Water [AW] has again refused to assist other Grantee[s] in maintaining said easement road. After billing, AW retaliated by blocking my ingress / egress to livestock located at top of ****************, with snow removed from their cistern.

    AW Lawyer, '*****, ****' <****************************************> reached out to me and agreed that AW will plow my driveway [AW easement road] once per snow event. However, AW AP ****************************************************************' has not reimbursed me for past expenses.  In addition, an AW employee opened my livestock gate and propped it open with cinder blocks, which allowed livestock to escape and cause damage.  This EE has done this before: his actions are intentional and malicious.  AW has now violated 61-3B-3.  AW also purchased ********* Utility who also owes me money.  Under 24-2-4g, AW is liable for damages caused by ********* Utility but not paid.  These include:  Releasing livestock that ate ~95lbs of dog food, defecated and urinated all over front yard and my front porch, did not assist in easement road maintenance and hitting fence posts with equipment but not repairing.

    61-3B-3. Trespass on property other than structure or conveyance.
    (e) If the offender defies an order to leave, personally communicated to him or her by the owner, tenant, or agent of the owner or tenant, or if the offender opens any door, fence, or gate, and thereby exposes animals, crops, or other property to waste, destruction, or freedom, or causes any damage to property by such trespassing on property other than a structure or conveyance, he or she is guilty of a misdemeanor and, upon conviction thereof, shall be fined not less than $100 nor more than $500, confined in jail for not more than six months, or both fined and confined.
