    I am a 75 year old widow. I just sold my house I’ve lived in for 32 years, a 9,100 sq ft home full of treasures accumulated over the years. I had an initial consultation with David M****** to help in downsizing. He came with his assistant/photographer, Ashley. I showed them around the house and its’ contents, just for them to have an idea of the quality and quantity of my stuff. Ashley started taking pictures but she said, not to worry, it is just for future reference. At that time I have not fully decided what to sell and what to take with me. During the tour of the house, they would ask if an item or furniture will be in the sale. Some of them I answered “yes” , some “no”, some “not sure” or “maybe”. Ashley continued to take pictures. They left a contract with me but I did not sign yet. On August 15, 2022 I signed the contract and emailed to Mr. M******. They told me to mark items that will not be in the sale, which I did. Sometimes there were items I wanted to keep but failed to mark but I just let that go. Ashley took pictures of items that will go in the online auction from Aug.26 to Sept. 1. The rest of the stuff was for the on site estate sale which I was not allowed to attend. David brought in 3 closets full of clothes and shelves of bric-a-brac that were not mine for the on site sale. There was so much stuff left over. David said everything will be donated or trashed. No list of donated items or even a picture was taken so I can put a value on the donation. He also put my things in bins and secured them so I was not able to take inventory. Fast forward to the computation of the proceeds coming to me, I was only due a sum of $2,800! He charged me “lost commission” from items they took pictures of on their initial visit that I decided to keep. I was clear at that time that I was not fully decided on what to sell and what to keep. I had not even signed the contract yet! Those are my things! How is he entitled to a commission?
