On the 1st of June 2022, I had *************************** (owner of Kinetic Resources LLC) do an estimate for installing a french drain in my yard. The estimate came to $2,200. I hired him to come to do the job three weeks later. I had to give him a down payment of $1,200 before the work was started. When he came, it looks like he was in a hurry, and when he completed the work, at the time everything looked fine. The next day we had rain and the drain system was really put to the test, my wife and I came to find out that the water was clogged in the drain and was not going anywhere. We called him to come and fix it, he came after almost two weeks to check it out. He just inserted a water hose into the drain to determine to see if the water was flowing. After examining everything, I came to the conclusion that our drain did not have the proper inclination for the water to move on to the next drain system, which was in my neighbor's yard. I spoke to him about receiving a refund for work not completed, and he told me that if he had to do anything would be new work and it would cost me $1,325 more to get it done. Why do I need to pay more for a job that was not completed in the first place? I have seen videos from ********** where gravel is added to create the inclination necessary to let the water drain but he never put any gravel when he installed it. I need the money to hire someone else to finish the job, because the water is still trapped since the first time he came, and it's not moving anywhere.

    Better Business Bureau:

I have reviewed the offer and/or response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

[Provide details of why you are not satisfied with this resolution.]

    Regards,

    ***************************

    Rebuttal:

    1. The offer provided by the business will ultimately not resolve my situation. If the two water drain boxes were removed and filled with gravel and soil, will block the water from entering the drain system. My initial request to the business was to provide me assistance to resolve my flooding coming from the adjacent homes due to the rainfall. My home is the point of entry for the water coming from the houses behind my fence, so I needed a system that will collect the water and send it directly to the drain and to the remaining drain of the homes after it leaves my home.

    2. The issue is that the water is stuck at the second drain box and does not go anywhere, it does not have the proper inclination to move the water forward so it can end up at the end of the line. I asked **************** for a fix, but I was told it would cost me $1,325 in addition to the $2,200 already paid. The job in my opinion is not complete because it does not drain as it should. The system is not working as intended, so that's the reason I asked for the line to be tested. It should be a matter of a quick fix to verify it. This job should have a warranty of at least 6 months in order to really check the effectiveness of the system.

    3. I don't doubt his experience, but right now I have been left with a system that it's not doing its job. All I need is for the water in the second drain box to run its course like it should and end up at the end of drain line. I was on travel when **************** informed me of the additional cost which I consider is unfair if the previous work is not complete. That's the reason I felt a meeting was not feasible or productive. After the first rainfall, it took a while for **************** to come see the line, and when he came to my home, he inserted a water hose from the second drain box to my neighbor's house to check it. I went to check, and the water was barely moving, so something was wrong.

    4. It's painful to see the water clogged in the drain box since the initial rainfall, and not moving at all. All subsequent rainfalls make the problem worse, because the water is not moving further from the second inlet. Several times I drained the water with a shop vac, but the inlet kept filling up, so it was frustrating to witness that. THERE SHOULD BE NO WATER AT ALL IN THE SECOND INLET BOX. I think the price I paid should cover the testing and the repair for the next 90 to 180 days. My whole problem revolves in that second drain box where the water stops and goes nowhere, that's the frustrating thing from this situation.

    5. So, in all fairness I requested at least a partial refund of $1,000 to help me hire someone else to either fix or redo it completely from scratch. There's no guarantee that if I pay the extra $1,325, the system will ever work. My neighbors don't have a problem, because the water comes in from my end, so they would never see their yards flood, since I have the problem now. That's where I stand right now. I never had the superficial or ground water issue, because the water will run its course all the way to my neighbor's yard and continue from there on. When the French drain was installed, it appeared to look fine, but the day after, the rain came hard and really tested the system.

    6. I'm completely dissatisfied with the system, and I should not have to pay a "red cent" if it's not working as it should. A business should always do their best to satisfy the needs of a customer, not just take my money and disappear.

    Business Response

1: The original request was NOT to address surface water, but to dry up the ground water spring, as explained previously.             2: The inlet boxes can assist the surface water flow but in no way could handle the amount of flow designed by the County.           3: According to County guidelines,if there is no standing water 48 hours after rain subsides, there is no sufficient problem as long as water flows away from foundation.                                                                                                                               4: The current system does work as intended for ground water and dries up after a rain.                                                             5: The neighbors pipe is in a cement sidewalk therefore the elevation cant be changed. The short span of connecting pipe did not overflow with the system being flushed with a garden hose for approximately 5 minutes as the owner witnessed.                           6: As the Owner states in item #5, my neighbors dont have a problem because the water comes in from my end. Which is it ? This tells me that the cement walkway and new sod are damming up some of the surface flow, but the drain inlet is still allowing water to flow through the system.
