    We currently employ Tri Borough Management (TBM) for our property management of a single family home in *******, **. We have a signed property management agreement that lays out terms associated with permissible expenses that do not require owner authorization. On 12 August 2024, after our move out and prior to the move in of our tenants TBM contracted pre-move in cleaning of the property without our approval. The signed agreement does not provide authorization for "spot cleaning" as it was called by TBM and only covers situations where "in the exercise of the Agents professional judgement, the use of and enjoyment of the Premises is substantially diminished or repairs are necessary for the safety and/or preservation of the Premisis to avoid the suspension of any essential services to Premesis, to avoid danger to life or property, or to comply with law or ordinance. We paid a professional cleaner to clean the same property on 8 July and then personally deep cleaned the property on 20 July and then conducted spot cleaning on 23 July. We contacted *** to refund the $250 to us since it was not authorized, nor communicated. TBM went on to lecture us about their broad authority to authorize repairs under $500 and that the property was vacant for a month and had "dust and finger prints." The property was not vacant for a month, nor was it without cleaning for a month. Their customer service remained very poor with a highly unprofessional follow-up call from their management team when we noted that we had the basis of a breach of contract and small claims case that we could file against them. We ask that they pay us $250 (thus agreeing that the expense was not approved), an apology for the unprofessional management engagement, and an acknowledgement that they will adhere to the written agreement in the future.
