      I contacted him to cut down a tree on my property. He agreed and stated that he couldn't take the tree to the mill but would dispose of it by placing it on the back of my property. So, I agreed to the terms. I've contacted him several times about moving the logs to the back of my property and he always says he'll come, but never does. I just want him to complete the job. Either move the logs to the back of my property as agreed or haul them away.

      On Wednesday, September 28, 2022 I contacted Mr. ******************** by cell phone to request an estimate to remove three trees from my back yard. He came immediately after a previous appointment and gave me an estimate of $2200.00 with removal scheduled for Monday October 2, 2022. He explained that a deposit of $500.00 was required. I gave him a personal check that day for $500.00 to cover the deposit. I told him that I don't usually pay the deposit until I have a detailed contract and requested a receipt for the paid deposit. He explained that he would send me a receipt by email within the next hour or so. I received the estimate/contract but it did not indicate that the deposit had been received and the balance due was still $2200.00. When I discussed this with him he stated that I needed to sign and return the accepted estimate by email and he would return the estimate back to me showing the deposit paid. I expressed my concern about accepting the estimate while it still showed that I owe the deposit. So he emailed another estimate/contract that showed a balance due of $1700.00 after a "discount" of $500.00 but stated that the deposit of $500.00 was still due. I contacted him again to let him know that this was not acceptable. He tried to explain to me that the system he uses does not allow him to go in to make changes even though he changed it to reflect a discount. I explained to him that I will not sign or accept any estimate or contract that indicates that the deposit is still owed and to please return my deposit immediately. After two weeks, no response. I contacted him again to ask when will I receive the deposit. He stated that he has a non refundable deposit policy and was still willing to do the job. At this point I don't trust him and refused his offer. I informed him again that I never signed or accepted his estimate/contract and to return my deposit as soon as possible. To date I have not heard anything more from him.

      Hello,

      Please see attached the estimate provided to ****************** as well as numerous text messages where we discussed the $500.00 deposit. She agreed to the job verbally and then gave deposit. All deposits are non-refundable. I explained to her that nothing else was due until the job was completed.

      I have reviewed the offer and/or response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      [The deposit was given to Mr. ******************** on the morning of 9/28/2022. The written estimate of $2200.00 was received later that evening after Mr. ******************** had received the deposit. I expected the estimate to show that the deposit had been received and the total cost due would reflect the deduction for the deposit. It does not. It states that the deposit was still due. Mr. ******************** has not done any work on my project and I would like my deposit returned.
