I would like to report a contractor that was doing a lot clearing project for my wife and I. We are both retired senior citizens. We hired Richard Ryder of CNR INC. at *** ***** ***** **** ***** ******** *** *****. Our land is in **********, Va. It is 1.4 acre. I met at the site, walked him around the property and told him, I wanted all the trees removed, so he sent me a job invoice with 2 options to choose from. Option 1 $6500.00 To root ball trees and stack in pile or Option 2 $10,000 To bring chipper to chip trees and pile root balls. We chose Option 2. Which was to remove trees and stumps, mulch the smaller trees and the bigger ones in a pile and put the mulch in a separate pile from the root balls. I met down on the property to sign the papers for him to get started, date ordered 7-7-24 terms weather permitting. He was not going to get started until the middle or toward the end of July. Then he told me could also put up the silt fencing at an added price of $1,600.00 so we added that on the contract also, well job invoice I mean. Which brought total to $11,600.00.. The new job invoice, starting date 7-20-24 to 7-27-24 weather permitting. They started the job, rain stopped. We got a call from Richard, saying the job was done, I drove down. I live in **********, Va. I walked the property, there was about 40 or more trees, that needed to go plus the stumps. I came home, received another call saying the job was complete, we had him on speaker phone, I asked and my wife asked all trees and stumps gone and he said yes. I went back, they were still working, all trees gone, I took him at his word, he got paid, $11,600.00. Went back later, looked at it, and saw that he did not remove the stumps, there were smaller trees that could have been mulched was put on the pile of stumps, I told him to keep mulch separate from the stumps, but that did not happen, then left a lot of debris on another property. They did a good job, but failed to finish it, the job is incomplete.

    Business Response

Job process was explained before start of project. -Unable to see lower property markers, customer came and pointed them out and we finished out concerned area. -small saplings left in pile because they were too small for the chipper to chip safely. -stumps and chips were put in designated pile to be able to load and remove in the future if customer desired later on. - only stumps left on property were large property line trees that we explained to customer we could not dig due to location(property line) -we offered to grind the stumps in question at discounted rate and customer denied to pay for this service.  -customer signed document agreeing that the job was complete to satisfaction. - there is nothing we have left to offer in order to make this customer happy.  -we wish them nothing but the best for their future endeavors with their property.

I have reviewed the response offer made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

He did not tell us about the stumps far from the property line and we should not have to pay him extra money for a job to complete that we have already pay him for, cut all trees and pull up all stumps on property that was the contract. And he said make it look like a desert and we said yes if no trees or stumps is a desert yes. He also was too make two separate piles one for the mulch and one for the tree stumps but he put them altogether in a pile. We feel like he took advantage of us because we are senior citizens.

    Regards,
