    The landscape contractor wrote an estimate for $******* to cut shallow drainage ditches in the backyard for heavy rain drainage. It was delayed 6 months due to winter and grass seeding that was my part. His part was to grade the ditches for gravity drain and rake off and haul away the sod that was dug up. the estimate was for 485' of ditch. 6 months later his crew showed up at my home completely unannounced and I directed where the work would be done which changed to 120' of ditch. The accomplished half of that work and two hours after they arrived they packed up and left without any notice, I assumed they went to lunch. My next correspondence was 4 days later with an invoice for $*******. That was on April 12, 2023. I emailed a response that with only *** *f the work had been done, and then abandoned, I was willing to pay ******* and they refused and demand payment in full with threats to send to collections.

    Mr. ***** estimate was written to solve a drainage problem that he had.   The job was delayed 6 months "on his request" to be delayed so the timing to re-seed his lawn would be in the right season.   I was ok with this.   I showed up and did the work "as the contract says".    No where in the contract does it say that I have to haul away any debris.  We tapered the soil within the grades.  No where, in the contract does it say that we had to deal with 485' feet.    No where in the contract does it say how far I needed to go.    Just that I would solve the drainage concern.   A transit tells you where the problems are in a grade and shows you where to grade to solve them.    I told him, in the estimate, that's exactly what I would do.     I showed up with a $****** tractor with all the proper equipment and manpower to accomplish the task in a very fast and professional manner.    His yard drains now as it should.   I did what the contract says I was suppose to do.     Just because I have the equipment and manpower to accomplish this faster than he thinks, I should not be punished by his failure to pay for this service.   If he wanted to take 3 days to hand shovel the grade then he should have hired someone else.

    I respectfully disagree with his point of view, his yard drains and that was what we said we would do; but, to settle this matter and save all the time this would take to litigate over an additional $******, I will agree to settle this matter.
