*********************** and I had our roof replaced by Three Mountain Roofing on April 14, 2023. The company is withholding our *************** because they want us pay more money than what we contracted to pay. I am attaching the contract. You will see that they say that if any sheathing (they call it sheeting) needs to be replaced it will cost $50.00 per sheet for labor and disposal plus the market price of the sheeting. They charged ** $53.00 per sheet for each of the 47 they used. We called ********** and Lowes on the day we received the invoice, and their sheathing was being sold for about $32.00 a sheet. We also called ****** Lumber where they told ** they got the sheathing and were told the cost was $36.20 per piece. We also inquired if they offered discounts as is normal for professional contractors and they said yes. So we know they paid less than $36.20 per sheet but accept the assertion that some might consider that amount the market price. We paid our invoice promptly but subtracted the difference between $53.00 and $36.20 per sheet. They told ** they mark up this product 40% to cover the cost of things like keeping their trucks running and disposal costs etc. They also said they would reduce the 40% to 20% to make ** happy. It did not make ** happy. They now want ** to pay $444.40 before they file for our warranty.Your help is greatly appreciated in resolving this matter.

She is correct the contract reads market price for sheeting. And it is priced like the fish of the day at a restaurant, when you order an item priced "market price" you are not going to pay the price that the restaurant paid for the fish you pay the value added price, and that is what was charged, the value added price. So no trickery was involved. We went to this system back in 2020 as the price of plywood would change on a daily or hourly basis, prices have since stabilized and  so to avoid this type of misunderstanding we have changed the contract to read replacement at $110.00 per sheet. We do apologize that this customer feels that they were somehow tricked, and we will pay the difference for them zeroing out the amount owed, and will file their warranty for them.
