      I contacted **** for exterior trim repair & paint in early Spring 2022 for rental house. He texted me May 9th that he looked at the house May 5th & he would send an estimate. May 22 he sent an estimate via email. The estimate included a timeline: start May 26 & completing May 30th. It stated weather can change the starting date or delay the duration. The contract required a 50% deposit due upon acceptance of estimate. June 1, I sent a text that the contract and check were mailed.We continued text messages. We were trying to coordinate with window work being done by another contractor. On May 13th I texted **** that we were ready for him to start. May 19th he texted with possible start times and said we still can be there within the next 2/3 weeks. Text May 22nd Im shooting to start that project on Thursdayfinished by Memorial Day if weather cooperates May 26th He texted rain in forecast so held off. We continued texting messages about paint color, rot, and weather issues through the summer. Sept 7th I texted asking Whats happening with Front Street? Sept 8th he texted his *********************** would be at at the house next week. Oct 3rd he texted he was planning to get there by next week Ill prob end up doing the project myself. I responded I appreciate your plan Communication continued and later in Oct it was too cold to paint. It was decided to move the project to Spring 2023. Oct 26th **** texted the ********* he uses closed his business. He made recommendations of carpenters for me to hire. Nov 7th I texted ****, I hired a new contractor with a ********* and paint staff to do the trim work. I requested my $900 deposit back. **** texted Im not gonna send that 900ASAP, prob after the holidays Feb 12th I texted asking for his time frame for return of deposit. No response. Mar 21 I texted & asked for an agreement for return of $. His response did not include any plan to return $.

      The customer has a signed contract with me and knew I was delayed in scheduling due to lack of workers and than decided shed sign and start a new contract without negotiating our current one. She voided the contract and per terms and conditons is not refunded the deposit. She should of reached out before choosing another contractor and negotiated our contract.

      To BBB,
      I would appreciate  **** providing a copy of the contract he is referring to as all I have in my records is an estimate. The estimate has deadlines for the work but does not confine me to working only with him. Below are the details of the estimate I have that are relevant to timelines.

      Planning on starting project for May 26th and completing it by May 30, 2022. *Please note that weather conditions can change the starting project date or delay the duration of the project.

      Given that the work was never done, I would like my deposit returned. Please note that **** texted me Nov 7th 2022  that he would return the deposit of $900.
