      On 8/9/23, my partner set up electric utilities with Grays Harbor PUD. Grays Harbor PUD charged a $700 deposit on setting up service to my residence. When speaking with the manager, *****, she explained they are charging a deposit based on the 2 highest bills. This is not 2 twelfth of the prior annual billing as limited by WAC 480:100:113 sec 3a. This is an illegal business practice. When questioned about adding someone else to the account to run credit, ***** would not allow that. Per the same law, WAC 480:100:113 sec 5b the company has to allow for a qualified guarantor to be added in lieu of a deposit. Their refusal to allow a guarantor is an illegal business practice.There was also never an offer to allow opportunity to provide a reference from a similar utility, as required by the same law WAC 480:100:113 sec 5d.I have paid $350 of the demanded $700 deposit so far. Due to the several illegal business practices commited by this company, I would like the full $350 be refunded to my account, and the remaining $350 owing be removed from my account.

      The individual complains that Grays Harbor PUD (District) is committing illegal business practices in violation ********** Administrative Code (WAC) ***********. The regulation referenced by the individual does not apply to the District. As stated in WAC *******-003(1), WAC Chapter ******* applies only to electric utilities that are subject to the jurisdiction of the ********** Utilities & ************************* (UTC). 

      The District is a municipal corporation operating under Title 54 of the Revised Code of Washington and is not subject to the jurisdiction of the UTC.  Under RCW 54.16.040, the District has full and exclusive authority, to sell and regulate and control the use, distribution, rates, charges, and price of electricity to its inhabitants. The District applied the requirements in its Service Policy, as adopted by the ********************* to the customer account.

      I am rejecting this response because:

      The response stated WAC ******* does not apply as WAC *********** states WAC-******* does not apply to districts, but this in not accurate.

      WAC *******-003(1) states:

      The rules in this chapter apply to any electric utility that is subject to the jurisdiction of the commission under RCW 80.04.010 and chapter 80.28 RCW. 

      RCW 80.04.010(12) defines electrical companies as:

      "Electrical company" includes any corporation, company, association, joint stock association, partnership and person, their lessees, trustees or receivers appointed by any court whatsoever (other than a railroad or street railroad company generating electricity solely for railroad or street railroad purposes or for the use of its tenants and not for sale to others), and every city or town owning, operating or managing any electric plant for hire within this state. "Electrical company" does not include a company or person employing a cogeneration facility solely for the generation of electricity for its own use or the use of its tenants or for sale to an electrical company, state or local public agency, municipal corporation, or quasi municipal corporation engaged in the sale or distribution of electrical energy, but not for sale to others, unless such company or person is otherwise an electrical company.

      There is no verbiage specific to districts. Grays Harbor PUD is an association and therefore governed by this law.
