On June 19, 2023 I deposited $300 for hearing aids and notified the office in writing the next day that I was cancelling. The agreement I signed specified I had three days to cancel / rescind. I have not received any of my deposit and would want the full amount returned.Initial Complaint

Miracle Ear representatives came to my 90 year old father's assisted living home on April 8th 2023 to test residents' hearing and to recommend hearing aids. I took my dad in for a hearing test because I noticed he had significant difficulty understanding words. He was tested and found to have moderate to serious hearing loss in both ears. he tried out one of the hearing aids they had and found that it did improve his hearing. We decided to buy it right there. It was the highest end aid costing $9,290 total. They charged his account on April 10th. I thought this would improve his quality of life. I noticed after a couple weeks he wasn't wearing them so I'd help him put them in his ears and remind him he needed to wear them to get used to them. When I saw him a week or so later he said they were too difficult to get used to and he wanted to return them. This was within the 30 day rescission agreement so I wrote a letter asking for a refund, dropped the hearing aids and the letter off at the Miracle Ear office on May 8th. The receptionist said the hearing rep who tested my dads hearing and sold him the hearing aids was out of the office for the day. She took the hearing aids and the letter and said she would be sure to let the representative know the date I had turned them in so they wouldn't be late. She said they had to have someone ok the refund and that should happen by the end of the week. I hadn't heard from anyone by Friday so I called on Monday and was told they hadn't heard back yet. I called again on May 16th and was told that they had refused the refund because i was late getting the recsission request in. The Purchase date was April 10th and I returned the hearing aids and letter on May 8th, which by my counting was 28 days. I'm not sure if I will still be able get any refund or even get the hearing aids back. According to our records the patients daughter called on 5/16/23 to return the hearings aids and this was outside of the 30 day window.
We are invested in improving ********************** hearing health and would like to invite him to schedule an adjustment follow-up at his earliest convenience. the first time earing a new pair of hearing aids be difficult as peoples brains hear sounds they have not heard for a long time, but with regular adjustments and a commitment to improving hearing health can discover all the sounds they have been missing out on.

Jan.2021 I bought hearing aids from Miracle Ear. My attachments will explain my complaint.Nov 2022 ,I met with ****** who sold me the devises originally. At which time he admitted that he DID NOT sell me the hearing aids I should have had since I stated I did not like behind the ear and requested in the ear.I have been patient but have not received response from anyone I have contacted. I want to return hearing aids to Miracle Ear because the minimum payment they quoted me ($116.00) was less than what ********************* said I would have to pay ($192.00). It's more than I can afford. This all started in June 2022. I haven't made any payments and Miracle Ear will not let me return the aids. It has since cost me about 300 points off my credit score. I don't want to get anyone in trouble, I just want to be rid of the aids and the hassle and maybe get my credit score back. According to **************** law, the return of hearing aids is allowed only within a specific period after purchase, and under certain circumstances. These include the malfunctioning of the device, a significant change in the user's **********************, or a change in the medical condition of the user. However, in your case, none of these conditions apply.
Additionally, our return policy clearly states that all sales of hearing aids are final unless there is a defect in the device, and we cannot make exceptions to this policy.
We understand your desire to return the hearing aid, but we are unable to honor your request at this time. We advise you to review the manufacturer's warranty to see if the device is eligible for repair or replacement.

Now Miracle Ear or ********************** whichever, can *** me or take whatever legal action that *** come next and further destroy my credit score and ***be me, financially, or they can buck up and have a little human quality in this digital, mechanized, legalized world and simply take the aids back and sell them to someone else. On Dec 14/2022 I purchased new hearing aids @ Miracle Ear in *******, **. 2001Hwy 248Ste 5. Mine were five years old and not good enough for my needs. The store was having open house with a company sales person at the store. He showed the model he would recommend because of my hearing loss. There were three main reasons I purchased that model, 1=correct model for my hearing needs 2=this model would stream smart phone calls to my hearing aid and third it would stream tv sound to my hearing aids. The main reason I purchased that model is because of the tv and phone streaming. My wife hears well so when we watch together the volume is too loud for her, so then I use bluetooth head phones, then we can not talk to each other. That tends to strain our relationship. Secondly, I work with ******************* loud noises in my shop so I miss most of my calls. I was told by the Miracle Ear sales person said this model would do both, stream tv and the phono directly to my hearing aids. The hearing aid has a program that will adjust the volume you hear the tv sound at, but it does not stream it, I have to manually adjust the phone to get that program.If my equipment is not compatible it should have been advised it would only work on certain units. I returned the next day 12/15/2022 and advised the manager of my problems. She said she would contact the salesman who sold the product to me. She was not sure anything can be done. I advised her this was not acceptable, they cane return my old aids and cancel the financing or provide the model of hearing aids that work a I was promised. Before making the deal I asked several times if this model would do as he said, he promised it would. None of the operations of directions of operation were covered with me. I was offered an appointment next week to see how they were working. There weren't any manuals with the hearing aids, I did get one when I returned the next day. I feel they have had enough time to get back to me. It's a major expense for a retired person on a fixed income. I am more then happy to pay the expense if the hearing aids worked as promised.Business Response

The end of may2022, I receive a letter from Mircle ear *** for a Free hearing exam with no obligations, and I would receive a free $100.00 Restaurant gift card. I had paid at least $5,000 for an upgraded hearing aid in ******* **********. through Miracle-Ear. The hearing aid was for my left ear was damaged in a car accident over 5 years ago. When I first got it I had to take it back to the Miracle Ear 3 straight times because it was hurting my ********** sent it out 3 times for repair. On the third time I physically handed it to the ************** the last time I saw it. over 3 months ago. About a week later I moved back to ********* ********** left my new address with the ******* store. About 3 weeks ago that store called me & said a hearing aid was being sent to me by *** MAIL. I never got Anything. About a week later ok I was told it was being delivered by ****** But I received a hearing aid for my right ear which I had also paid for. I filled a complaint with Miracle-Ear last week. I called them back today & was told that the store in ******* said they had sent it back to me awhile Whois totally untrue. **************** has very specific laws to returning hearing aids. It is allowed but you must deliver a letter to the office stating the specific reason why you would like to return. This patient just tried to leave them at the office and we will not accepted that as a return. The patients reasoning of a simple change of mind is not accepted under state laws. We will send the aids back to her as they are her property. We are willing to work with the patient to get them hearing as well as possible.

I am elderly and have tried to work out a solution with this company about a pair of hearing aids that did not work as advertised. However, this company had me sign for a loan and took cash from me. In 2020 i paid $7000 for a pair of hearing from Miracle Ear in *********** **********.They never helped much w my audibility.I had constant mauntanace appointments for this issue. Even a reapir.On 01/04/2022 at a maintenance appointment ********************* and ************************* his "Boss" per Mr ****** convinced me to try a new advanced in technology, lots of features hearing aids.They told me I had 30 days to returned them, no questions asked.************************* pointed at the place I had to sign. I was never explained any parts of the form. I picked up the hearing aids on 02/04/2002 and on 02/06/22 I text ********************* for a return. They felt the same as the old pair. The right side felt like a plug and they slipped out.I went to his office that week. He told me I couldn't return them, to fill out a customer refund form.He'd send it to ********************** to see if it would get it approved.Itd wake a while. On a 2/22/22 in an in-person appointment Mr ***** told me my request got denied and that if he tried taking the hearing aids back he'd get charged for them.He'd send the customer refund form to headquarters this time.My daughter told him the contract said I had 30 days for return.He said the contract said 3 days and pointed at part 1, said that 30 days had expired since the day of the contract agreement,(I received them 30 days later) I said Alley Lending was billing me $6250 for them,I never applied or signed for a loan with him.He told me to wait on headquarters.2weeks later he offered me a discount on in the ear better technology set, total amount of $5250.Took my $2000 deposit, ear impressions to later tell me the company didn't approve the newer set.I couldn't get a refund leave his office and go somewhere else to see if they'd help me with my hearing problems and give me the hearing aids I want.I saw an audiologist since, and there's no need of a hearing aid on my right ear, it's been long gone.Yet I was still fitted and sold a pair since my very first fit at this Miracle Ear office

The patient was informed at the time of purchase that he has 30 days to return if the aids are not working but a simple change of mind does not constitute a reason. It is printed on the signed purchase agreement. **************** has very clear recession laws and each patient is sent home with a copy for their records. The patient filed a dispute with Ally and we sent them a copy of the payment agreement that was gone over and signed in the office. We adjusted his payments with him twice to find the payment that works for him.
The patient has had 2 aids for the last 3-4 years and his statement the he only needs on is not correct. He has a loss in both ears and we are able to treat them both. We are willing to adjust the aids to his prescription but the patient has not been willing to allow us to fix some of his problems.

I am rejecting this response because: I disagree that I applied, approved or signed for loan with ********** through miracle ear for $6,290. I was never told about this loan until I received a bill from them. I was blind folded with promises to sign a contract for the hearing aids and pointed where to sign. There isn't anything in the contract that says I had to apply for a loan with ***** bank. There has been forgery to obtain the loan under my name. I was told "30 day trial for return, no questions asked". I also disagree with the reason for return, I never stated I had changed my mind about the product. I specifically told ********************* they were not helping with my hearing needs, they felt the same as the old pair I was using, they were not any better as he said they would be. This is stated on the costumer refund form ********************* signed on February 10, 2022 and supposedly turned in for me to Miracle ear, including to headquarters. This is 9 days after the delivery of the hearing aids. The hearing aids were delivered to me on February 1, 2022. I also told him they were falling out and were uncomfortable. ***** tried to make daughter and I believe I only had 3 days to return the hearing aids referring to Section 1 of the purchase contract. Which is cancellations for purchase made outside of his business office. The same day he also said the 30 day trail period had passed from the day of the purchase agreement. How can I try something I didn't have yet? He also told me I couldn't just leave the hearing aids in his office becasue he was just going to throw them away. As per WAC *********** **************** law my rights to rescission rights have been violated. Per Reasonable cause for recession WAC ***********, I was promised the hearing aids were going to be better than the ones I already had, which ********************* was servicing at the time him and his "boss" *********************** convinced me to try the 30 day trial hearing aids. They failed to accept my return after 9 days the instruments were delivered. WAC *********** I also was never referred to a specialist to address my severe hearing loss. Instead, I was tricked to sign a medical waiver without my knowledge. My ear doctor says I do not need a hearing aid for my left ear. Per RCW 18.35.110 (b) and (i) ********************* has refused and failed to honor what was promised to me, including the agreement recession of purchace. About the adjustment to my payments, he said he would replace the new hearing aids with even better with more technology ones. He took a $2000 dollar check and then said those hearing aids were not approved for me. He told me and my wife not to come back to his office.
I want Miracle Ear to return the $2000 that was cashed, and to refund ***** bank for the loan that was taken under my name, so that the collection agency ***** bank has sent me to gets resolved.

********** State does have a 30 day return period and the rules are very specific. The patient needed to present the office with a letter stating the reasonable cause for return. This was not done and the patient stated on February 10th 2022 that the hearing aids were helping his hearing. We will not terminating the contract.
The payment program was gone over with the patient on the delivery date and he willingly gave us his social security number so we could process the payment.

I want to have my $2,000.00 refunded for the different type of hearing aids ********************* said had requested for me and were denied by the company and for Miracle Ear to refund ********** $3.200.00 that was charged to a loan they opened up under my name, which now I am in collections for.
Miracle Ear or the person who made the reponse is lying. Mr. ********************* told me there was just 3 days trail period not 30 days period as his boss *********************** told me. Then he said the 30 days had expired anyway from the day of the agreement. How can I try something I dont have yet. This last response is stated I didnt present any letter stating a reasonable cause for return. I did filled out the Costumer Return Form that ********************* gave me to fill out in which I stated They dont help my necessity they are the same as the old pair of hearing aids I have.In no part of the Costumer Return Form I say the hearing aids are helping my hearing. Attached is a copy signed on February 10, 2022 by ********************* and I.The hearing aids were delivered on February 1, 2022. By the State law this is a reasonable cause.
The day I got lured into purchasing new advanced hearing aids, I was told I had 30 days to return no money down, no questions asked. I was never told a loan was going to be opened under my name . until now I find out my social security was used for that. No loan review in any forms, signature or approval was made on my part,. I bought hearing aids from ******************* the ******* Branch manager for $7,493.00 on November 9, 2021. They were not fitted properly, painful and it took 3 fittings to be correct. I told ***** and his *** his receptionist I was moving to ******** and would need service there. ***** said no problem they could be serviced in ********. We talked about ******** at every appointment and I asked him to provide a contact for the place in ******** before I left. He never did provide any contact before I left. They began giving me problems after 3 months and I could not find anyone in ******** to service them. They finally failed June 1st 2022. I called ***** and *** at Miracle Ear ************** on 6/2. I asked for Steves email and *** gave it to me. ***** was supprised no one would work on them. He said they fix other brands. I asked him were to get them fixed and he did not help me. I spoke with him several times and reminded him that he told me they could be serviced in ********, but would not tell me were. I asked for a refund and he said he would contact the owner, he did not. I asked *** and ***** for the email for the owner and they said the owner would contact me he did not. I sent another email to ******************* at his business and it came back as blocked I told ***** and *** that the email was blocked and no one is returning my emails. They both said they contacted the owner but I have had no response for 4 weeks. I was told I could get service in ******** and can not I now want a refund or partial refund and they will not contact me. They are not working and no service is available and ***** said they could be serviced here.Business Response
