This is a clarification letter for my original complaint ID ********. Firstly thank you for sending the message to my email address for I could not read it through your website portal. After reading the letter response from AAA there's a few errors and a few things left out I want to address. The destination of my vehicle was never at any point at the ***** The amount of time shouldn't be a factor for my complaint to expire. I was told on two occasions that a representative would call me and I never received ANY calls from AAA period. The vehicle parked with the wheels up on the sidewalk was the main factor to why the vehicle was impounded and AAA made no mention of that in their letter. Had I received a call from the tow truck driver I would have gladly given him a more suitable location to drop off the vehicle, but he never called me with any concerns. In summary the vehicle was towed using a friend's current AAA plan and the driver should have known better than to leave the vehicle on the sidewalk facing the opposite direction of traffic. He never made any attempts to call me about the situation and just left it there. Regardless of the time factor I did try and contact AAA on several occasions and never once received a call back from a representative which only served to compound the amount of time. I should have been confident in their towtruck drivers ability to drop off the vehicle in a suitable and correct manner and my vehicle would've never been left in such a way that the city deemed it that it would be towed away due to the way the driver left it. If he wasn't able to drop it off facing the correct way then he should've called me and I would've given him another location. It's very nice of AAA to say that time was a factor and they consider the case closed, but their drivers negligence was directly the cause and reasons for the city to intervene and impound it, and not by my own hand or doing. Therefor it is not my responsibility to incur any costs.

      Business Response

      Date: 07/21/2022

In regards to Mr. ******** BBB Complaint # ********:

To address Mr. ******** **** statement: On November 26, 2021, a request was placed online for a tow using a AAA membership. The address for the tow destination was entered as ************************** by the person submitting the request. Per ******* this is the location of the ********************. At 2:32 PM, our dispatcher verified this address with the person answering the phone number provided to us, assuming it was our member, and was told it was their residence. Later, the tow destination was changed with the provider to another address on ******* Avenue a few blocks away. That address has since been identified as Mr. ******** residence, and he has also stated this call was placed by him. ****************** is not a AAA member.

As stated in our previous response, the service provider dropped the vehicle off in the only manner that was safe given the one-way street, the position of the truck on the flatbed, and Mr. ******** instructions. If there were issues with service, there was ample opportunity for ****************** to contact AAA prior to the vehicle being impounded on November 29, 2021. He was clearly aware of the position of the vehicle prior to impound as he took a picture of it, yet there is no record of communication with AAA prior to February 26, 2022. The vehicle was sold at auction on December 29, 2021. ****************** had a month to retrieve it from impound but did not take that opportunity. AAA has responded to these complaints as completely as possible. We consider this matter closed.

      Customer Answer

      Date: 08/11/2022

I am not satisfied. The information is incorrect and the business is being dishonest and tactically attempting to avoid responsibility. The tow was called in by my friend *****************************, membership #******************* and the *** membership policy states that ANY vehicle is covered for service. The **** address was yet again an error on the driver's part. The vehicle was not safe from being immediately impounded and had I received a phone call from the driver I would've given him multiple other options where to leave my vehicle. I have a side street access and a backyard he could've used as an alternative drop off location. The business still refuses to acknowledge the vehicles wheels up on the sidewalk which was a contributing factor to why it was towed. The tow was covered under my friends membership policy, it's irrelevant if I was aware of the vehicles position. I was working out of town and my wife took the photo, and I expected *** to competently provide the service that was offered and dropped the vehicle off without issues, and again I don't see how time is a factor in trying to solve the problem I have that they created for me. Like it expired or something. My friend payed for and has since renewed his membership policy with *** towing and along with paying he expects a certain level of professionalism and the service that was provided was sub-par and it should not be my loss considering *** is also an insurance provider.  I don't care if the guy said the safest way he could've left it was at the bottom of a lake, he is still at fault and did not provide the level of professionalism we were expecting from such a reputable and longstanding business like ***. I will retain an attorney to litigate this matter in a court of law if *** continues to avoid responsibility and consider the matter closed and done with. I contacted *** several times before contacting the Better Business Bureau and although they said a representative would contact me I never received anything from anyone. I believe they ignored me in hopes that I would just leave it be and go away, but I have the time and resourced to take this matter all the way up until I am made whole or we reach a settlement agreement for my vehicle I'm out of.
