      We purchased annual Taekwondo membership for two kids last October covering until 12/01/2024, paying $3940.20 for two students. We happened to move to another city about an hour away this July and asked if refund for the unused services be possible, but was told that their policy is no refund policy on any case whatsoever. They offered to continue attending even after we moved, which is about 1 hour away. As a full time office worker, I couldn't provide rides due to work schedule and giving 2 hours rides twice a week is too much. They say it's their policy, but we're losing over $1200 for unused service over 3 months (considering 1 month free benefit of annual membership). I feel the no refund policy in any circumstances is toxic to the customer.

      Thank you for bringing this matter to our attention. We appreciate the opportunity to address the concerns raised by ***************** and provide a comprehensive response.

      First and foremost, we confirm that ***************** is indeed our customer. Recently, she requested a refund for the remaining months of her children's annual membership due to a move to another city(*********, **). We have communicated with her multiple times via email, explaining our refund policy, which is also clearly stated in our membership agreement. Unfortunately, our policy explicitly states that no refunds are provided once the payment is made.

      Our taekwondo school offers three types of membership options:

      *Continuous Membership: This is a month-to-month membership that allows members to cancel or suspend their membership at any time without any long-term commitment.
      *Semi-Annual Membership: This is a 6-month membership that requires a one-time payment. It offers a $10 monthly discount, free uniform, and registration fee waiver. Additionally, it provides flexibility for vacation or medical leave by allowing membership suspension and extension.
      *Annual Membership: This is a 12-month membership that requires a one-time payment. It includes a free month, free uniform, and registration fee waiver. Similar to the semi-annual membership, it allows for suspension and extension during vacation or medical leave.

      ************** children first joined our school on March 28, 2023, under a Semi-Annual Membership. They received several benefits, including a $150 discount per person due to our grand opening special, a waiver of the 3% credit card processing fee, and a 10% family discount. When they renewed their membership in October 2023, they opted for the Annual Membership, benefiting again from the associated discounts, including the family discount and waived processing fee as a gesture of appreciation for their continued support.

      The reason for detailing these benefits is to highlight that ********** was fully aware of our membership policies and chose the Annual Membership to take advantage of the substantial discounts and benefits. Despite the availability of a month-to-month membership that offers complete flexibility, they elected the annual option knowing the commitment it entails and the policy regarding refunds.

      We have always emphasized our no-refund policy to all semi-annual and annual membership subscribers, especially given the significant payment involved. We also recommend the Continuous Membership(month-to-month) to those concerned about potential unforeseen circumstances to avoid any inconvenience.

      While we understand the inconvenience caused by the move, our policies are in place to maintain fairness and consistency for all our members.

      To further assist, I am including copies of the membership presentation given to ********** and the signed application form and terms & agreement. These documents clearly state our no-refund policy, which ********** acknowledged and agreed to upon registration.

      ************** children have actively participated in their classes and recently completed their promotion test on June 22. We empathize with the difficulty the move has caused and are committed to ensuring the remaining membership period until December 1, 2024, is utilized to its fullest extent. We are open to adjusting the schedule or extending the membership period to accommodate their needs. Additionally, we are more than willing to assist in transferring to a nearby taekwondo school to continue their training.

      I am rejecting this response because:

       

      There are mainly three things I don't agree with them.

      First, about the benefits:
      When I paid $3940 for annual membership for two students last October, I know the annual membership benefits were applied. Monthly charge is $199, but the amount I paid was for 11 months which was listed as one of the annual membership benefits.
      For credit card processing fees and registration fees waiver benefits, I don't agree with what they say.

      When I first purchased Semi-Annual membership last year I was told that if I used the same credit card for renewal no credit card processing fee would be charged. I used the same credit card that I used previously, and the benefit was from contining the program with the same credit card. For the registration fee waiver, we haven't received new uniforms, but continued with old ones we received from previous registration.

      Excluding all the annual membership benefits, if we had purchased month-to-month membership, we would have paid $199 per month. For 8 months membership, the fee would be $3184 for 2 students. We paid $756 for unused services even after all the annual membership benefits applied to us being charged back.

      The business ownered gave me a detail of their calculations of the amount we could have paid if we paid month-to-month. That amount included credit card processing fees and registration fees into the amount I had to pay per monthly membership. As I said, I don't agree these two types of fees should be included as benefits I received. Even in their calculations, they acknowledge that there is a few hundred dollars that they are taking for un-provided service. But they still refuse to refund per their No Refund policy.

      Second, about the accommodations offered by the business:
      Even though the business owner says they offered accommodations, they are not accommodations at all to me. They are more like accommodations to them. The new place we move is about an hour away from the business. Two-way travel considering the Metropolitan traffic matter will consume about 3 hours back and forth. On top of that my work schedule cannot meet the business schedule to provide rides for the students. How would I use the offer to travel more than 2 times to consume the membership sooner when I even can't travel once a week (the membership offers two sessions a week). They don't have weekend session currently. As a full-time office worker, this does not offer any accommodations.

      Third, about the No Refund Policy:
      This is my first time to see a business practice and policy which offers No Refund policy in the ****** over decades except dollar shop type of businesses. This is a toxic policy and practice that does not offer any refund at all in any circumstances for unused services. This No Refund policy at all circumstances is abusing consumers who have to leave the service even under unexpected circumstances, not providing protection to consumers' right.
      The business I'm filing a claim against is not selling a couple of dollars manufactured items. They say they offer high quality of service of tawkwondo trainings. Their refund policy should reflect their advertisement of high qualiry service. For the unused service, they need to prepare refund policy to protect consumers. In case this business practice continues, consumers like me that have to leave the service due to unexpected circumstances can end up paying thousands dollars for unused services at the most.

      I indeed signed for the annual membership. I didn't expect to move this year at all. Life circumstances changed and my family has to move. Excluding financial accommodations or any applicable accommodations, nothing is actually offered as accommodations.

      For better business practices, please review the refund policy and offer more responsible and ethical options to consumers.
