    We entered into a contract with JMS Landscaping and Construction LLC on ******* (JMSLALC8090H) - but the work was not completed until January 20, 2022. The contract was to remove existing concrete, grade, install rebar and pour concrete for our driveway. The work was completed and we had issues with the fact that they had crushed part of the blacktop and there response was they only care for the concrete! So, out of kindness they came and painted on the blacktop which did not help the patch that was crushed. Around summer, patterns began developing in the concrete and it would not wash away so I contacted *********************** around September to discussion a remedy. I also told her to take the picture of our driveway off of their website as it certainly no longer look proper. I also wrote on Yelp regarding the issues we were having and she became angry about that and they subsequently have removed the landscaping in their name and they are now JMS Concrete and Construction LLC.Since September, there has been nine emails between us and the company regarding a resolution for the defective driveway. Intermixed in those emails, have been phone calls with *********************** and their Concrete ***************************** of *************************. **** came and worked some sort of solution into the driveway and it did not fix the problem, in fact it made it worst as now the white concrete is a dirty brown intermixed with the dark gray patterns. The last conversation I had with **** was on 11/17 and he said that he couldn't remember us and that it was not their problem. I sent an email 12/23/22 to ******* now telling her that **** is no longer taking any responsibility and there has been no response.

    JMS Concrete & Construction LLC has been in regular contact with the client addressing their concerns. We are currently waiting on the weather to improve and working with the schedule for the concrete mixer. We intend to resolve this issue. Regarding the Yelp Review: We did not ask Yelp to remove the clients review. Yelp filtered the review as part of their algorithm. We ask that the client address us by our business name and refrain from using the personal name of anyone in our company while addressing this matter through the Better Business Bureau.

    I am rejecting this response because and I have copied some of email correspondence and have more. 

    The contractor failed to indicate that our original contract which you have was made out to JMS Landscaping and that ******* did contact me regarding my original very detailed YELP review which included a picture of our driveway on their website which we DID NOT authorize.   The company files now reflect JMS Concrete and Construction (formerly JMS Landscaping LLC).   I did remove the original complaint to JMS Landscaping and what I have found on YELP, it is important to NAME the owners or those responsible for the project.   

     

    The email strings attached provides example of the lack of information given to us via how to resolve the issue.  **** of ******** was blamed and he came out an put a solution on our entire driveway (and our neighbor's driveway who have the same problem but smaller discolorations) and we did not park on the driveway for 10 days and the solution only made things worse with the solution making the driveway a dirty brown and the defective spots a bright gray.  The last conversation I had with ****, he said this firm was not responsible?  So, we have had NO correspondence with *********************** of JMS Concrete since then.  

    I will send along more information if needed like she called us a liar in that we had to paint our gararage door because someone had slopped concrete on the two bottom panels (we didn't take a picture unfortunately.

    We have made efforts to solve the issue through multiple follow up meetings and communication.  The client refuses to act in good faith to work through a resolution.  Her comments regarding reviews and our responses on review sites indicate an attempt to do harm to our business.  Additionally, she has been critical of our change in DBA.  The change in business name was part of our strategy, happened prior to the complaint and not relevant to her project or this issue.

    I am rejecting this response because: we are AWAITING for this firm to call us to resolve our defective driveway.  WE have sent you only parts of the correspondence with the latest showing that we have not receive any follow up phone call or email to set an appointment for ******************** doesn't matter if it was a business decision or not to change their name, the contract is very clear who we entered into a contract with and we don't care if they change their name a third time.  we are EXPECTING a PHONE CALL or EMAIL to set a meeting to resolve this issue.  **** walked away and said it was in the hands of the contractor who we paid over $10,000 and we HAVE A DEFECTIVE PRODUCT which they WARRANTY their concrete.

    We will be meeting with the client, as well as the owner of the concrete supply company on Friday March 3rd at 1:30pm to discuss the possible solution to this issue.  The delay had been due to the availability of the concrete supplier.

    I am rejecting this response because: Attached is the email chain that I started regarding the concrete supplier contacting me and talking about a potential solution of painting the driveway.  We did not ask to have the driveway painted, we want it replaced but have accepted meeting with them to discuss the solution to this defective product.  If the concrete is in short supply, the Contractor could have stated that to us when ****** last correspondence to me was it was not there fault.  We have had a concrete specialists identify that the concrete may have had to much lye, too much water, or a mixture of both and should not have been poured during the winter months unless it was covered.  i have had friends tell me to *** the company and have them rip it out and start over.  We seem to be spinning wheels and at least we received a correspondence from JMS and reasons why they did not contract us last year.  WE do not believe this case is resolved yet, which is why we are stating it is not resolved as they have not been transparent with us in the past and we have heard mixed messages from their concrete supplier.

    To clarify - we met but the issue of the defective concrete slab HAS NOT been resolved as our attorney has looked at the driveway and said it should be replaced.  

    in good faith, we met with the concrete person and contractor and of course the do not recommend replacement; instead they offered to utilize a brand new concrete solution product and we will test it on the defective sidewalk that is adjacent to the defective driveway.  It is a brand new product that we have no details on to research.  We will need to provide upkeep on the driveway as even though it is not paint - it is a solution that degrades with time.  So I will have to talk to a realtor as to if we will have to disclose that defect when we sell the house.  Our home is assessed at over $1.5mm. 

    So, for now we have achieved their attention and met and are looking to see what this new product can do.  The last solution the concrete company used last year only made the large spots more prominent as a gray pattern and dirtied the cement which is why our attorney suggest replacement.  

    A real estate broker said for sure the price would have to be dropped by $50,000 - if not more as it is so ugly (only sent few pics).  She also said folks will think any remodel we did inside the house would also be viewed as substandard and therefore the house may even need to take a $100k hit on the price as no buyer will believe anything we say.
